This insightful Handbook examines how labour unions across the world have experienced and responded to the growth of neo-liberalism. Since the 1970s, the spread of neo-liberalism across the world has radically reconfigured the relationship between unions, employers and the state. The contributors highlight that this is the major cause and effect of union decline and argue that if there is to be any union revitalisation and return to former levels of influence, then unions need to respond in appropriate political and practical ways. Written in a clear and accessible style, the Handbook examines unions' efforts to date in many of the major economies of the world, providing foundations for understanding each country. Policymakers, analysts, academics, researchers and advanced students in employment, industrial and labour relations as well as political economy will find this unique Handbook an important resource to understanding the contemporary plight and activity of labour unions.

Bulletin of Comparative Labour Relations Now that the idea of the workplace and the traditional view of working time are undergoing major challenges, it is important to rethink the questions of what is work and what is the meaning of work. This book delves into the problems and issues raised by these questions today and explores new pathways and answers. Fourteen distinguished labour and employment law experts contribute insightful examinations of developments and trends in the world of work that have a penetrating impact on the ways in which we understand and approach labour law. The book is the result of the Third Conference in Commemoration of Professor Roger Blanpain, organized by the Institute for Labour Law of KU Leuven in September 2023. In a collection of papers, the contributors explore such aspects of the rapidly changing work landscape as the following: working with smart technology and artificial intelligence; protection of the self-employed and teleworkers; the erosion of boundaries between work and personal life; the ‘right to disconnect’; protection of worker privacy in an era of heightened surveillance; reconciling the EU General Data Protection Regulation (GDPR) with labour law requirements; labour law protections beyond the human worker to include the environment; work in periods of crisis; precarious work; wearable technology in workplace monitoring; and robots in the workplace. With a core consideration of the relationship between labour law and the individual, the overall perspective proposes a transformative vision where labour law becomes the law of social freedom, intrinsically linked to personal development and social recognition. The diverse contributions together provide a crucial foundation for reimagining labour law and advancing our understanding of the evolving meaning of work by highlighting the necessity for legal frameworks to respond to unprecedented global, technological, and social transformations. With its practical insights into contemporary workplace issues, critical analysis of work-life balance, and guidance on managing technological change, it will be welcomed by practitioners, academics, regulators, and social partners working in the fields of labour and employment law.

Globalization has led to growing labour fragmentation and widening of gaps in social protection. Although the enterprise is increasingly expected to be socially responsible, in actuality extreme worker inequalities and social dumping have become ubiquitous worldwide. This volume – the first to focus attention on the ‘theory of the firm’ as it reveals itself in today’s world from a multidisciplinary perspective – underscores the necessity to rebuild a new scientifically controlled paradigm that acknowledges and regulates the dimension of power in the functioning of the organization. In their contributed essays, nineteen renowned scholars in labour law and industrial relations rethink the firm, its conception, its value, and its regulation, analysing such aspects as the following: – labour-management relations issues that arise when companies go global but workers remain local; – the firm as a social construction; – the continuing necessity for collective bargaining; – concealment of the employment relationship under the guise of self-employment; – concealment of the real employer behind figureheads and shell companies; – social welfare effects of outsourcing; – the company’s interaction with the network of suppliers and with local education processes; – determining who actually carries responsibility towards workers; – overcoming companies’ drive to enter the global market in response to national regulation; – realizing the notion of ‘duty of care’; – mechanisms of participation of workers in the management of the enterprise; and – the persistent limitations that women face in the workplace, even when worker participation is advocated. With attention to innovative developments in Germany, Italy, Japan, and other countries, analyses include case studies of specific companies as well as case law, in particular the European Court of Justice’s jurisprudence in matters of collective dismissals, seconded workers, and public contracts. In their head-on tackling of the fragmentation and blurring of social responsibility in enterprise organization, these important essays propose a view of the enterprise as a factor in a new ‘constitutionalisation’ of labour that shifts employment protection from single legal entities to the network’s economic activity, thus realigning the legal boundaries of the enterprise with its economic reality. As a compelling investigation of how a satisfactory implementation of labour standards in the fragmented enterprise can be guaranteed, this book will be studied by entrepreneurs, managers, consultants, corporate lawyers, judges, human rights experts, and trade unionists, and will be welcomed by academics and researchers in industrial relations and labour law.

Globalization And Labour In The Twenty First Century written by Verity Burgmann and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-04-14 with Political Science categories.
The Open Access version of this book, available at http://www.tandfebooks.com, has been made available under a Creative Commons Attribution-Non Commercial-No Derivatives 3.0 license.Globalization has adversely affected working-class organization and mobilization, increasing inequality by redistribution upwards from labour to capital. However, workers around the world are challenging their increased exploitation by globalizing corporations. In developed countries, many unions are transforming themselves to confront employer power in ways more appropriate to contemporary circumstances; in developing countries, militant new labour movements are emerging. Drawing upon insights in anti-determinist Marxian perspectives, Verity Burgmann shows how working-class resistance is not futile, as protagonists of globalization often claim. She identifies eight characteristics of globalization harmful to workers and describes and analyses how they have responded collectively to these problems since 1990 and especially this century. With case studies from around the world, including Greece since 2008, she pays particular attention to new types of labour movement organization and mobilization that are not simply defensive reactions but are offensive and innovative responses that compel corporations or political institutions to change. Aging and less agile manifestations of the labour movement decline while new expressions of working-class organization and mobilization arise to better battle with corporate globalization. This book will be of interest to students and scholars of labour studies, globalization, political economy, Marxism and sociology of work.
