En el presente estudio se analiza la responsabilidad civil que pudiera corresponder a los padres por los hechos dañosos cometidos por los hijos sometidos a su patria potestad, a la luz del artículo 1903 del Código civil y del 1902 también, tomando en consideración los nuevos vientos de incremento de la independencia y libertad de los hijos dichos, con la consiguiente disminución de las facultades correspondientes a los padres en materia de educación, guarda y control de aquellos, vientos nuevos que podrían poner en cuestión la bondad de soluciones que se vienen predicando en la materia respecto de la presunción y ámbito de la culpa in vigilando o in educando, por no hablar de la responsabilidad objetiva o por riesgo, imputada por la jurisprudencia a los padres referidos, quizás con demasiado rigor.

Esta monografía estudia si en la actualidad es posible aplicar, con carácter general, la normativa reguladora de la responsabilidad civil extracontractual en el ámbito de la familia, tanto en el caso de reclamaciones por daños entre cónyuges como entre progenitores e hijos. Y en el supuesto de que la respuesta sea afirmativa, la autora analiza qué especialidades o cambios han de experimentar las normas de la responsabilidad civil cuando inciden en el Derecho de Familia, sobre todo en cuanto al criterio de imputación subjetiva y el canon de diligencia exigible. La primera parte se detiene en las razones por las que nuestro ordenamiento jurídico, de un modo tradicional, ha excluido el Derecho de Daños de las relaciones familiares, destacando, entre otras, el modelo de familia recogido en los Códigos Civiles decimonónicos, el carácter ético o moral atribuido a los deberes familiares, el peligro de proliferación de demandas triviales, la ruptura de la unidad entre los miembros del grupo familiar y la aplicación exclusiva de las normas del Derecho de Familia para la resolución de los litigios que se plantean en el seno de la familia. La segunda parte profundiza en diversas hipótesis de daños que pueden surgir en el ámbito de las relaciones paterno-filiales: daños derivados del hecho de ser un hijo extramatrimonial, daños derivados del incumplimiento del deber de fidelidad matrimonial y posterior engaño al hijo sobre la verdadera paternidad de éste, daños resultantes de la negativa a reconocer un hijo extramatrimonial, daños derivados del incumplimiento de ciertos deberes paterno-filiales (como el deber de velar, el deber de educar y el derecho-deber de visita) y, por último, daños prenatales ocasionados por los progenitores a sus hijos (como, por ejemplo, las enfermedades o lesiones transmitidas a éstos últimos por herencia o por contagio). La lectura de este trabajo reviste utilidad sin duda para estudiosos y para aplicadores del derecho, tanto por la novedad del tema escogido como por el enfoque que ha tratado de proporcionar la autora, teniendo en cuenta, además de las actuales circunstancias sociales, históricas y económicas, el sentido común, imprescindible en una materia como ésta. Desde luego el Derecho Comparado ha constituido una herramienta muy útil, permitiendo extraer algunos criterios de solución válidos para nuestro ordenamiento.

Little Women is a novel by American author Louisa May Alcott, which was originally published in two volumes in 1868 and 1869. Alcott wrote the books rapidly over several months at the request of her publisher. The novel follows the lives of four sisters—Meg, Jo, Beth, and Amy March—detailing their passage from childhood to womanhood, and is loosely based on the author and her three sisters. Little Women "has been read as a romance or as a quest, or both. It has been read as a family drama that validates virtue over wealth", but also "as a means of escaping that life by women who knew its gender constraints only too well".[6]:34 According to Sarah Elbert, Alcott created a new form of literature, one that took elements from Romantic children's fiction and combined it with others from sentimental novels, resulting in a totally new format. Elbert argued that within Little Women can be found the first vision of the "All-American girl" and that her multiple aspects are embodied in the differing March sisters. The book has been adapted for film twice as silent films, and four times with sound, in 1933, 1949, 1978 and 1994. Four television series were made, including two in Britain in the 1950s and two anime series in Japan in the 1980s. A musical version opened on Broadway in 2005. An American opera version in 1998 has been performed internationally and filmed for broadcast on US television in 2001.
