In 2006, Babiak and Hare alerted the public to the danger of “corporate psychopaths,” psychopathic individuals occupying positions of power in business organizations. Since then, academicians and the public media have advertised their presence, documented the harm they can cause, and issued a call to arms to identify corporate psychopaths and eliminate their presence in the workplace. Very little attention has been paid, however, to the ethics of such a “seek and destroy” mission. The Ethics of Employment Screening for Psychopathy argues that employment screening for psychopathy would be illegal and unethical. On legal grounds, Brian K Steverson argues that psychopathy would qualify as a protected disability under the Americans with Disabilities Act, and, hence, medical screening to identify potential corporate psychopaths would be in violation of the ADA. On ethical grounds, the case is made that such screening would violate a social commitment to equal opportunity, would constitute a morally unjustified violation of personal privacy, and would, in practice, not produce the intended benefits, while at the same time inflicting harm on the subjects of the screening.

Investigations of specific moral dysfunctions or deficits that shed light on the capacities required for moral agency. Psychopathy has been the subject of investigations in both philosophy and psychiatry and yet the conceptual issues remain largely unresolved. This volume approaches psychopathy by considering the question of what psychopaths lack. The contributors investigate specific moral dysfunctions or deficits, shedding light on the capacities people need to be moral by examining cases of real people who seem to lack those capacities. The volume proceeds from the basic assumption that psychopathy is not characterized by a single deficit—for example, the lack of empathy, as some philosophers have proposed—but by a range of them. Thus contributors address specific deficits that include impairments in rationality, language, fellow-feeling, volition, evaluation, and sympathy. They also consider such issues in moral psychology as moral motivation, moral emotions, and moral character; and they examine social aspects of psychopathic behavior, including ascriptions of moral responsibility, justification of moral blame, and social and legal responses to people perceived to be dangerous. As this volume demonstrates, philosophers will be better equipped to determine what they mean by “the moral point of view” when they connect debates in moral philosophy to the psychiatric notion of psychopathy, which provides some guidance on what humans need in order be able to feel the normative pull of morality. This view is often expressed in a paradigm that regards human conduct as the "dependent variable," while anything that impinges on the human being is considered the "independent variable." The paradigm further takes the relationship between the dependent and independent variable to be the result of natural law. It charac teristically ignores the possibility that individual or collective deci sion or policy, generated by human beings and not by natural law, is and can be regulatory of conduct.
