This title was first published in 2001. In the Nordic countries women are considered equal to men. Advanced social and economic rights are often given as the explanation for the equality. In this volume, Nordic feminist legal scholars give a more contradictory image of gender equality. The gendered construction of the legal subject and the legal understanding of gender have a two-pronged potential, both to change and to reproduce gender relations. Nordic women have been considered responsible for upholding the gendered social system - as "responsible selves" rather than as individuals engaged in rights discourse. The authors claim, with examples, that the belief in equality has made certain discriminative practices difficult to recognize and conceptualize. Also a transformation of the social welfare system puts the collective equality policies to the test.

Lode Walgrave has made a highly significant contribution to the worldwide development of the restorative justice movement over the last two decades. This book represents the culmination of his vision for restorative justice. Coming to the subject from a juvenile justice background he initially saw restorative justice as a means of escaping the rehabilitation-punishment dilemma, and as the basis for a more constructive judicial response to youth crime that had been the case hitherto. It is commonly believed that people in certain circumstances possess a right to self-defense. This exists not only on an individual but also on a collective level, historically known as Just War Theory. During the 20th century this theory has undergone a revival in academic circles, mainly due to the invention of nuclear weaponry, the cold war and America’s military involvement in Vietnam. Yet, many of the assumptions of the Just War Theory have been challenged and undergone a revision, and a separate school of thought has emerged: the “revisionist” just war theorists. A core feature of their philosophy is viewing war as the continuation of different forms of conflict, such as self-defense. The moral justification for war needs to, therefore, stem from the same source of morality. This book is about the philosophical debate on the moral basis for self-defense. The accounts of two main protagonists in the field, Judith Jarvis Thomson and Jeff McMahan, are outlined. The former takes a rights-based approach to self-defense, the latter a responsibility-based one. Subsequently the author develops his own account, which is a partial synthesis between the former two, albeit remaining a responsibility-based one at its core. He introduces the conceptual differentiation between perspectives into the fundamental level of justification, which gives rise to a separate, supplementary criterion. The author also addresses the points of criticism raised against the former two accounts and shows how his own is better equipped in responding to the challenges raised against McMahan’s responsibility-based account.

The often violent emergence of new independent states following the end of the Cold War generated discussion about the normative grounds of territorial separatism. A number of opposing approaches surfaced debating whether and under which circumstances there is a right for a community to secede from its host country. Overwhelmingly, these studies placed emphasis on the right to secession and neglected the moral stance of secessionist movements as agents in international relations. In this book Costas Laoutides explores the collective moral agency involved in secessionist struggles offering a theoretical model for the collective responsibility of secessionist groups. Case-studies on the Kurds and the people of Moldova-Transdniestria illustrate the author’s theoretical arguments as he seeks to establish how, although the principle of self-determination was envisaged as a means of gradually bestowing political power upon the people, it never managed to realize its full potential because it was interpreted strictly within a framework of exclusionary politics of identity.
