The increasing popularity of restorative justice has prompted new and varying applications of its core principles. The authors of The Promise of Restorative Justice highlight the ways that these new ideas now spark innovations both throughout the criminal justice system and in arenas as diverse as business, education, athletics, and the aftermath of ethnic conflict. They offer fresh approaches to addressing the problems of crime and other human conflicts in ways that productively incorporate the values of mutual respect, accountability, and ultimately reconciliation between offenders and victims.

Restorative Practice Meets Social Justice: Un-silencing the Voices of “At-Promise” Student Populations is a collection of pragmatic urban school experiences that focus on restorative approaches situated in the context of social justice. By adopting this approach, researchers and practitioners can connect and extend long-established lines of conceptual and empirical inquiry aimed at improving school practices and thereby gain insights that may otherwise be overlooked or assumed. This holds great promise for generating, refining, and testing theories of restorative practices in educational leadership and will help strengthen already vibrant lines of inquiry on social justice. The authors posit that a broader conceptualization of social and restorative justice adds to extant discourse about students who not only experience various types of daily oppression in US schools but also regularly live on the fringes of society. Chapters are written by a combination of researchers and practicing school leaders who believe in the power of healing and restoring relationships within school communities as opposed to traditional punitive structures. The dynamic approaches discussed throughout the book urge school leaders, teachers, school community members, and those who prepare administrators to look within and build bridges between themselves and the communities in which they serve.

Restorative justice is an innovative approach to responding to crime and conflict that shifts the focus away from laws and punishment to instead consider the harm caused and what is needed to repair that harm and make things right. Interest in restorative justice is rapidly expanding, with new applications continuously emerging around the world. The restorative philosophy and conference process have shown great promise in providing a justice response that heals individuals and strengthens the community. Still, a few key questions remain unanswered. First, how is the personal and relational transformation apparent in the restorative justice process achieved? What can be done to safeguard and enhance that effectiveness? Second, can restorative justice satisfy the wider public’s need for a reaffirmation of communal norms following a crime, particularly in comparison to the criminal trial? And finally, given its primary focus on making amends at an interpersonal level, does restorative justice routinely fail to address larger, structural injustices? This book engages with these three critical questions through an understanding of restorative justice as a ritual. It proffers three dominant ritual functions related to the performance of justice: the normative, the transformative, and the proleptic. Two justice rituals, namely, the criminal trial and the restorative justice conference, are examined through this framework in order to understand how each process fulfills, or fails to fulfill, the multifaceted human need for justice. The book will be of interest to students, academics, and practitioners working in the areas of Restorative Justice, Criminal Law, and Criminology.

The Healing Of Nations written by Mark R. Amstutz and has been published by Rowman & Littlefield this book supported file pdf, txt, epub, kindle and other format this book has been release on 2005 with Philosophy categories.

How does one forgive an international political transgression as deep as genocide or apartheid? Forgiveness is often conceived of as an element of personal morality, and even at that it is difficult. This book argues that it is also an essential part of political ethics, especially when dealing with collective wrongdoing by political regimes. In the past, a retributive justice demanding prosecution and punishment of all past offenses has kept the international community away from moving on to the next step in regime change. Here, Mark R. Amstutz takes a restorative justice approach, calling for nations to account for crimes through truth commissions, public apology and repentance, reparations, and ultimately forgiveness and the lifting of deserved penalties. The distinctive feature of forgiveness is the balance it strikes between backward-looking accountability and forward-looking reconciliation. The Healing of Nations combines a theory of the role of forgiveness in public life with four key case studies that test this ethic: Argentina, Chile, Northern Ireland, and South Africa. Amstutz uses the hard cases to illustrate the promise and limits of forgiving without forgetting.

In reviving the idea of an informal approach to conflict resolution, the Restorative Justice movement attempts to break out of the freedom punitive thinking which shapes modern criminal justice. Its proponents claim that its guiding ideals - personalism, participation, and reintegration -deliver a fairer, more effective, and more humane justice than does the court system. However, a simplistic tendency both to extol the virtues of restorative justice and to denigrate all formal approaches risks blinding enthusiasts to the dangers inherent in unchecked participant power , as well asto the protection which State institutions and professionals can provide to individuals and communities. The procedural safeguard of institutional accountability helps reduce these dangers. Examining the experiences of 25 programmes in six countries, Accountability in Restorative Justice uncovers a number of neglected, overlapping, and incomplete types of accountability, including the informal typebuilt into deliberations between victims and offenders and their supporters. This deliberative accountability can provide a rigorous check for regulating decision-making, holding state agencies accountable, and monitoring the completion of agreements reached between participants. This book also considers the role played by formal types of accountability, such as external review. It suggests a new approach, in which judges become more involved in monitoring the quality of deliberation in restorative justice conferences than with enforcing traditional sentencing principles.
