This volume contains a detailed study of the applicable international law relevant to peace operations in the context of collapsed states, in the establishment of safe havens or in a general enforcement role. It discusses the interaction and the often complex legal relationships between non-government humanitarian actors, relevant UN agencies, the warring parties and international peace forces under international law and practice. In particular, the book deals with issues concerning the implications of contemporary peace operations for military forces in terms of force structure, operating procedures and training. The book focuses on the often overlooked but critical issues of the interim administration of law and order in complex operations and on the reconstruction of a local capability in this regard. Many contemporary operational challenges are analysed, including the Balkans and the Middle East. In particular, the book includes a detailed case study of Somalia based on the author's personal knowledge, experience and access to information on the ground in his capacity as military legal adviser to the Australian Defence Force Contingent in Somalia.

This book explores the question of whether peacekeeping commanders can be held accountable for a failure to protect the civilian population in the mission area. This requires an assessment of whether peacekeeping commanders have an obligation to act against such serious crimes being committed under domestic and international law. The work uses the cases of the Dutch and Belgian peacekeeping commanders in Srebrenica and Kigali as examples, but it also places the analysis into the context of contemporary peacekeeping operations. It unfolds two main arguments. First, it provides a critical note to the contextual interpretation given to international law in relation to peacekeeping. It is argued that establishing a specific paradigm for peacekeeping operations with clear rules of interpretation and benchmark criteria would benefit peacekeeping and international law by making the contextual interpretation of international law redundant. Second, it is held that alternative options to the existing forms of criminal responsibility for military commanders should be considered, possibly focusing more clearly on failing to fulfil a norm of protection that is specific to peacekeeping and distinct from protective obligations under international human rights law and international humanitarian law.

Gabrielle Simm's critical re-evaluation of sex between international personnel and local people examines the zero tolerance policy on sexual exploitation and abuse and its international legal framework. Whereas most preceding studies of the issue have focused exclusively on military peacekeepers, Sex in Peace Operations also covers the private military contractors and humanitarian NGO workers who play increasingly important roles in peace operations. Informed by socio-legal studies, Simm uses three case studies (Bosnia, West Africa and the Democratic Republic of the Congo) to illustrate the extent of the problem and demonstrate that the problems of impunity for sexual crimes are not just a failure of political will but the result of the structural weaknesses of international law in addressing non-state actors.
