Perbedaan laki-laki dan perempuan, baik dari segi substansi kejadian maupun peran yang diemban dalam masyarakat, telah menimbulkan perdebatan dan diskusi yang cukup panjang bahkan masih menyimpan masalah. Indonesia dan Malaysia merupakan negara yang mengadopsi ketentuan fiqih sebagai peraturan hukumnya, termasuk dalam hal hadânah, keduanya menetapkan ibu sebagai pemegang hak asuh utama bagi anak yang belum mumayyiz pasca terjadinya perceraian dan juga sama-sama memberikan hak pilih bagi anak mumayyiz untuk diasuh oleh ayah ataupun ibunya. Penelitian ini bertujuan untuk menganalisis bagaimana hakim dan para pihak yang berperkara di Pengadilan Agama menginterpretasikan hak reproduksi perempuan sebagaimana terdapat dalam putusan yang disusun oleh hakim berdasarkan hukum tertulis/tidak tertulis dengan perspektif hukum feminis. Penelitian ini merupakan penelitian yuridis yang bersifat kualitatif dengan pendekatan feminis dan pendekatan yuridis normatif. Sumber bahan hukum primer dalam penelitian ini adalah putusan Pengadilan Agama di wilayah DKI Jakarta (2015-2019). Sedangkan sumber bahan hukum sekunder berupa referensi yang terkait dengan penelitian. Data yang telah terkumpul dianalisis secara deskriptif-analitis dengan menggunakan metode analisis isi (content analysis). Hasil penelitian menunjukkan bahwa tipologi hakim Pengadilan Agama didominasi oleh paham positivistik. Hal ini terbukti dengan penggunaan undang-undang sebagai dasar dan sumber satu-satunya dalam memeriksa, memutus dan mengadili perkara. Posisi hakim dalam melakukan penemuan hukum juga masih terbatas. Akibatnya keadilan yang tercipta dari putusan tersebut masih terbatas pada keadilan prosedural administratif dengan titik tekan kepastian hukum saja. Meskipun di sisi lain penelitian ini juga membuktikan bahwa hakim telah terbebas dari pandangan stereotip gender. Akan tetapi kebebasan hakim dari pandangan stereotip ini tidak diiringi dengan terwujudnya putusan yang berkeadilan gender. Pasalnya, dalam putusan tersebut hakim tidak mempertimbangkan terjadinya ketimpangan relasi suami istri, hak-hak perempuan dalam pernikahan, keadaan psikis perempuan serta riwayat kekerasan yang dialami perempuan dalam rumahtangga. Hal ini didukung juga oleh pandangan suami yang masih subordinatif dan stereotip gender dalam memahami hak reproduksi perempuan. Alasan- alasan di atas berdampak pada terabaikannya hak-hak perempuan pasca perceraian. Penelitian ini senada dengan penelitian Fauzan Arrasyid (2019), Dwi Reiza (2019), Defi Uswatun Hasanah (2017) Husein Muhammad (2014), dan Edi Riadi (2011) bahwa sensitivitas gender hakim Pengadilan Agama dalam putusannya masih belum optimal sehingga hak-hak perempuan secara substantif masih terabaikan. Penelitian ini tidak sependapat dengan penelitian Stijn Cornelis van Huis (2015), Ridwanul Hoque (2007) dan Morshed Mahmood (2007) yang menilai jika aktivitas di peradilan agama telah berkeadilan gender.
