Specifically, it reflects the view that collusive arrangements between ocean carriers are necessary to prevent market instability ('destructive competition') and that, unlike other industries, consideration of the arrangements would not be handled appropriately under the Part VII provisions. Testing these views is an important part of the Commission's assessment.
