Water—or the lack of it—has shaped the contours of the American West and continues to dominate the region's development. From the incursions of the Spanish conquistadores to the dams of the New Deal era, humans have sought water in these arid lands as the key to survival and success. And as the West becomes more urbanized, water is an issue as never before. This book sets contemporary and often bitter debates over water in their historical contexts by examining some of the most contentious issues that have confronted the region over five centuries. Seventeen contributors—representing history, geography, ethnography, political science, law, and urban studies—provide an interdisciplinary perspective on the many dimensions of water in the West: Spanish colonial water law, Native American water rights, agricultural concerns, and dam building. A concluding essay looks toward the future by examining the impact of cities on water and of water marketing on the western economy. Rumblings of revolution have stirred for decades, bolstered in recent years by increasing evidence of the impossibility of a distant, centralized government successfully managing the West's widespread and far-flung lands. In This Sovereign Land, Daniel Kemmis offers a radical new proposal for giving the West control over its land. Unlike those who wish to privatize the public lands and let market forces decide their fate, Kemmis, a leading western Democrat and committed environmentalist, argues for keeping the public lands public, but for shifting jurisdiction over them from nation to region. Environmental conflict resolution (ECR) is a process of negotiation that allows stakeholders in a dispute to reach a mutually satisfactory agreement on their own terms. The tools of ECR, such as facilitation, mediation, and conflict assessment, suggest that it fits well with other ideas for reforming environmental policy. First used in 1974, ECR has been an official part of policymaking since the mid 1990s.
