"The 1996 Intergovernmental Conference (IGC) will be a crucial turning point for the future of the European Union. All over Europe, lawyers, governments, political scientists and the world of industry are gearing up to the IGC and it is important that citizens of the Union are offered quality information on the Conference. With this series of seminars, organised under the aegis of the Centre for European Legal studies (Cambridge), Professor Alan Dashwood aims to offer informed propositions and reasoned contributions to this debate." "Bringing together an eminent panel of scholars and practitioners from varied backgrounds, the seminar series examines the items on the IGC agenda, identifies priorities and suggests solutions for the revision of the Maastricht Treaty. From the reform of the Common Agricultural Policy to the balance of powers, from Economic and Monetary Union to Social Policy, and from variable geometry to enlargement, the panel scrutinised the vital issues that will be central to the IGC." "The first four seminars examine respectively the questions of the distribution of powers between the Members States and the Union; the issues of Democracy, Accountability and Transparency; Enlargement and External Relations; and the Common Foreign and Security Policy. The fifth seminar draws the previous debates together and endeavours to propose viable options for the revision of the Treaty."--BOOK JACKET.Title Summary field provided by Blackwell North America, Inc. Constitutional Law Of The Eu S Common Foreign And Security Policy written by Graham Butler and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-10-03 with Law categories.

The Common Foreign and Security Policy (CFSP) of the European Union is a highly exceptional component of the EU legal order. This constitutionalised foreign policy regime, with legal, diplomatic, and political DNA woven throughout its fabric, is a distinct sub-system of law on the outermost sphere of European supranationalism. When contrasted against other Union policies, it is immediately clear that EU foreign policy has a special decision-making mechanism, making it highly exceptional. In the now depillarised framework of the EU treaties, issues of institutional division arise from the legacy of the former pillar system. This is due to the reality that of prime concern in EU external relations is the question of 'who decides?' By engaging a number of legal themes that cut across foreign affairs exceptionalism, executive prerogatives, parliamentary accountability, judicial review, and the constitutionalisation of European integration, the book lays bare how EU foreign affairs have become highly legalised, leading to ever-greater coherence in how Europe exerts itself on the global stage. In this first monograph dedicated exclusively to the law of the EU's Common Foreign and Security Policy in modern times, the author argues that the legal framework for EU foreign affairs must adapt in a changing world so as to ensure the EU treaties can cater for a more assertive Europe in the wider world. Analyses the likely future of the EU following next year's Intergovernmental Conference (IGC) which is likely to be even more significant for the future of Europe than the Maastricht Treaty. Since Maastricht it has become clear that future developments are less certain with regard to the EU and integration. The IGC will have to try and resolve tensions such as: "widening" Europe to include former communist countries whislt also trying to "deepen" Europe with increased political and economic integration; providing a framework which is acceptable to a core of countries (Benelux, Germany, France) who favour more integration and an early move to monetary union with countries such as the UK, which does not.

The common foreign and security policy (CFSP) of the European Union and its member states reflects an unprecedented form of international cooperation on the borderline between international law and European Community law. While more 'supranational' European community, CFSP in this book is presented as a form of legal cooperation that is far from informal. The former diplomatic European Political Cooperation has developed into a policy in which the states still play an important role, but where their competences are shared with the international organisation called the European Union. Conclusions on the interpretation of the 'CFSP legal order' and on the legal status of the European Union are based on a thorough analysis of the purposes and scope of CFSP, the decision-making procedures, the nature of the CFSP decisions, the existing supervisory mechanisms and the competences of the European Union. The book addresses the key issues of international institutional law in an original and clarifying manner. This makes the book not only a valuable source for academics working in European Union law and international institutional law in general, but also for practitioners involved in national and European foreign policy making. The book contains an extensive bibliography as well as a list of adopted CFSP decisions.

A Constitutional Order Of States written by Anthony Arnull and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2011-03-03 with Law categories.

This collection celebrates the career of Professor Alan Dashwood, a leading member of the generation of British academics who organised, explained and analysed what we now call European Union law for the benefit of lawyers trained in the common law tradition. It takes as its starting point Professor Dashwood's vivid description of the European Union as a 'constitutional order of states'. He intended that phrase to capture the unique character of the Union. On the one hand, it is a supranational order characterised by its own distinctive institutional dynamics and an unprecedented level of cohesion among, and penetration into, the national legal systems. On the other hand, it remains an organisation of derived powers, the Member States retaining their character as sovereign entities under international law. This theme permeates both the constitutional and the substantive law of the Union. Contributors to the collection include members of the judiciary and distinguished practitioners, officials and academics. They consider the foundations, strengths, implications and shortcomings of this conceptual framework in various fields of EU law and policy. The collection is an essential purchase for anyone interested in the constitutional framework of the contemporary European Union.
