The book deals with illicit trafficking in the Mediterranean, seen as a borderline issue between mobility and security under a strongly interdisciplinary approach. The opening part is dedicated to issues that transversally concern illegal trafficking: criminological, criminal law, criminal procedure, but also international law issues. This part presents a kind of general theory of illegal trafficking, showing its recurring aspects and identifying the legal and criminal-political issues that would be best addressed by a unified approach to the matter. The other parts are devoted to presenting, instead, a special part overview of illegal trafficking. The second and the third section are devoted, in particular, to illegal traffics having human beings as their objects. More specifically, the second part examines smuggling of migrants, which has a central - criminological and criminal-political - relevance among the illegal traffics taking place in the Mediterranean. The third part deals with the neighbouring theme of human trafficking, especially in its connection with the problem of labour exploitation. Finally, the fourth part focuses on some trafficking in goods, offering a selected and representative overview of some of the most significant forms that such trafficking can take: tobacco trafficking, drug trafficking and trafficking in cultural goods.

Analyzing the political consequences of the most extensive corruption investigation in recent Latin American history, Operação Lava-Jato, Media Leaks and Corruption in Brazil answers two central questions about the contradictory effects news media has on political systems. Enquanto na cultura popular "quem cala consente", na doutrina jurídica o acusado tem direito ao silêncio, não se podendo lhe imputar culpa pelo simples fato de haver exercido esse direito. Alguns dizem que a opção do acusado pelo silêncio é contrária à moral comum e que o silêncio é incompatível com a inocência. Essa afirmação somente seria plausível caso se admitisse, ingenuamente, que o acusado, somente se fosse inocente, desejaria a absolvição, mas, se culpado, submeter-se-ia espontaneamente à condenação. A Constituição brasileira de 1988 consagra o direito ao silêncio. Contudo, ainda há juízes que violam esse direito fundamental, imputando culpa ao réu pelo fato de haver permanecido calado em seu interrogatório. Alegam que a opção pelo silêncio, embora derivada de uma disposição constitucional, não impossibilita o convencimento do juiz de que o acusado é culpado quando o acervo probatório é suficiente para a condenação. Esse argumento não é razoável, pois, por um lado, se o conjunto probatório fosse suficiente para a condenação, não se justificaria a inferência negativa ao silêncio; por outro lado, se há necessidade de se reforçar os argumentos da condenação com uma inferência negativa ao silêncio é porque a prova não está além de toda dúvida razoável. Ademais, seria contraditório se o ordenamento jurídico permitisse que o exercício de um direito justificasse uma condenação. Ou é direito e, então, não pode haver prejuízo pelo seu mero exercício, ou não é direito.

Este livro se propõe a uma análise dos aspectos positivos e negativos da institucionalização dos meios consensuais de solução de conflitos no Brasil, em especial da mediação e da conciliação. As vantagens da mediação e da conciliação são muitas: pacificam as partes, restauram a convivência e possibilitam reparar e corrigir atos ilícitos. No entanto, em muitos casos os meios autocompositivos são apresentados como uma alternativa melhor que a tutela jurisdicional. Para o Estado, sob o argumento da crise do Judiciário, resta claro que tal afirmativa faz sentido, visto que, a despeito da qualidade do resultado, se houver um acordo, abrevia-se o fim do litígio e reduz-se a taxa de congestionamento; mas para os envolvidos os meios autocompositivos nem sempre são o melhor caminho para a solução de um litígio, pois um acordo ruim não é solução melhor que a tutela jurisdicional. Assim, a utilização da mediação e da conciliação deve se dar de forma adequada, com a observância das garantias processuais e da satisfação dos interesses das partes, a fim de evitar que estes instrumentos gerem pseudossoluções que apenas contribuam para reduzir demandas em números sem, entretanto, solucionar os conflitos de forma justa e definitiva.
