According to traditional Jewish and Islamic law, animals must be slaughtered by a single cut to the throat. The practice of ritual slaughter has become controversial to the extent that it is interpreted as precluding animals from being stunned first. This raises a number of important and related questions. What are the limits of animal welfare? What are the limits of the right to freedom of religion? What is the best way to discuss this dilemma in a democratic society under the rule of law that also respects minorities? In three essays, the authors reflect upon these and other questions. Jan Willem Sap emphasises that the state must continue its dialogue with Jews and Muslims with the aim to improve animal welfare to the greatest possible extent. Carla Zoethout argues that respect for animal welfare can serve as a legitimate aim to limit the right to freedom of religion and the practice of unstunned ritual slaughter. Gerhard van der Schyff considers equality to be the central value in structuring the relationship between law and religion in the Netherlands when it comes to decision-making on ritual slaughter. The protection of animals at the time of slaughter is regulated at EU level by Council Regulation (EC) No 1099/2009. The regulation states that all animals should be stunned prior to having their throats cut. However, in order to ensure that some religious communities can consume meat in accordance with their precepts, and on the basis of the fundamental right to freedom of thought, conscience and religion, enshrined in the Charter of Fundamental Rights of the European Union, a possible derogation from the stunning obligation may be applied. While it is up to individual Member States to decide whether to use this derogation, or to prohibit outright the slaughter of animals without stunning, the procedure is the subject of ongoing discussion and concern. While some groups see slaughter without stunning as a threat to animal welfare, religious groups defend their freedom to express their faith and recognise respect for animal welfare as a fundamental basis of their beliefs. According to scientific evidence, both methods of slaughter, with and without stunning, have critical points. In addition, the interpretation of scientific evidence, and that of religious beliefs, is part of the debate.

The article addresses the question of limits on religious free exercise and whether animal protection is a significant enough interest to pose a limit to religious freedom. The article examines a trilogy of cases: the 1994 U.S. Supreme Court decision in Church of the Lukumi Babalu Aye v. Hialeah, the 2000 European Court of Human Rights decision in Cha'are Shalom Ve Tsedek v. France and the 2003 German Federal Constitutional Court's "Schächten" decision. Comparing the cases, some observations regarding religious pluralism will be offered that address both the status of minority religions as well as the relationship between the majority and minority groups within the same religion. Moreover, different understandings of humane slaughter will be addressed.

Stunning animals before slaughter and avoiding unnecessary suffering is mandatory throughout the EU. Although the EU Animal Slaughter Regulation allows for a 'religious exception' departing from such a practice, it also expressly enables Member States to adopt “national rules aimed at ensuring more extensive protection of animals at the time of killing”. That's how Denmark, Sweden and Slovenia were able to, ban slaughter without stunning tout court. The Flemish region falls short of banning un-stunned slaughter, by prescribing instead reversible stunning. This method, by rendering the animal unconscious only for the time it takes to cut its throat, seems to respect the religious requirement of it remaining alive so the blood is pumped out by its still beating heart. According to well-established scientific evidence, this method is not only less traumatizing for the animal, and makes its handling easier for the butcher, but it is also accepted by a growing number of representatives of these religious communities. However, reversible stunning - as prescribed by the Flemish region - now faces a major legal challenge across Europe, having been challenged before the Belgian Constitutional Court, which has in turn referred the matter to the Court of Justice of the EU.This amicus curiae brief argues that a legislation - like the Flemish decree in question - prescribing an alternative stunning procedure for the slaughter carried out in the context of a religious rite is permissible under Union law, not least having regard to the guarantees of religious liberty and freedom contained in the Charter. It presents reversible stunning as a method that successfully balances the apparently competing values of religious freedom expressed in ritual slaughtering on the one hand and the concern for animal welfare on the other under current EU law.

The Santeria religion of Cuba—the Way of the Saints—mixes West AfricanYoruba culture with Catholicism. Similar to Haitian voodoo, Santeria has long practiced animal sacrifice in certain rites. But when Cuban immigrants brought those rituals to Florida, local authorities were suddenly confronted with a controversial situation that pitted the regulation of public health and morality against religious freedom. After Ernesto Pichardo established a Santeria church in Hialeah in the 1980s, the city of Hialeah responded by passing ordinances banning ritual animal sacrifice. Although on the surface those ordinances seemed general in intent, they were clearly aimed at Pichardo's church. When Pichardo subsequently sued the city, a federal court ruled in the latter's favor, in effect privileging the regulation of public health and morality over the church's free exercise of its religion. The U.S. Supreme Court heard Pichardo's appeal in 1993 and unanimously decided that the city had overstepped its bounds in targeting this particular religious group; however, the court was sharply divided regarding the basis of its decision. Three concurring opinions registered distinctly different views of the First Amendment, the limits of government regulation, and the religious freedom of minorities. In the end, the nine justices collectively concluded that freedom of religious belief was absolute while the freedom to practice the tenets of any faith were subject to non-discriminatory local regulations.
