Due avvocati e un giudice (anzi, una giudice) sono i protagonisti di un romanzo corale, denso e avvincente. Tra cause di lavoro, indagini penali e procedimenti disciplinari; tra commissioni parlamentari, istituzioni della Repubblica e servizi segreti; tra giornalisti infidi, generali vanitosi e industriali spregiudicati; tra vite solari, vite infelici e vite blindate; tra amori, matrimoni e divorzi; la vicenda si snoda sino a un epilogo senza consolazione, ma anche senza rassegnazione. Ora sul filo dell’attualità (Berlusconi, Prodi, il CSM), ora sul filo dei ricordi (il ’68, gli anni di piombo, le stragi di mafia), le vite private e le professioni pubbliche dei protagonisti del romanzo si intrecciano con la storia passata e recente del nostro Paese. E una causa di licenziamento diventa metafora dei vizi e delle virtù dell’Italia e degli italiani, con sullo sfondo Garibaldi, Hemingway, Che Guevara, Falcone e Borsellino. Su tutto, la Giustizia italiana. Con le sue lungaggini, le sue disfunzioni e le sue miserie. Ma anche con la sua vitalità, la sua dignità e la sua nobiltà. Com’è per davvero, insomma: né come teoricamente dovrebbe essere, né come vorremmo che fosse.

Das Buch untersucht nullum crimen sine lege als europäischen Grundsatz. Die Untersuchung konzentriert sich auf die Rolle der Vorhersehbarkeit als Lösung für die Legalitätsprobleme, die sich aus dem Richterrecht im Strafrecht ergeben. Die Vorhersehbarkeit und seine Entwicklung werden in der Rechtsprechung des EGMR untersucht. Aktuelle Lösungen, die von Zivilrechtsstaaten (Italien und Deutschland) angenommen wurden, werden auch unter Berücksichtigung der theoretischen Grundlagen von ncsl analysiert. Darüber hinaus wird die Rolle der Vorhersehbarkeit im EU-Recht als Beispiel für eine wirkungsorientierte Rechtsordnung betrachtet. Abschließend werden Zukunftsperspektiven für die Umsetzung der Vorhersehbarkeit analysiert.
