Aborda el autor el estudio de la apelación «reconvencional» en la jurisdicción penal, que es como en su obra La apelación «reconvencional» civil rebautiza y justifica la tradicional apelación «adhesiva». La segunda instancia ha sido el objeto de uno de los debates jurídico-procesales y constitucionales de mayor calado, resuelto aunque parcialmente, por el TEDH enmendando al TC. El autor expone la evolución del recurso de apelación desde la época del Derecho Romano hasta la Ley 41/2015, de 5 de octubre, con la que se ha llevado a cabo, para la jurisdicción penal, la “generalización de la segunda instancia”, con una regulación del recurso de apelación que no está exento de problemas que analiza y cuestiona. Defiende un sistema de apelación que sin llegar a constituir un novum iudicium amplíe las facultades revisoras; critica el carácter supeditado de la adhesión al recurso; discute la interpretación jurisprudencial de la prohibición de la reformatio in peius; justifica el principio de inmediación indirecta en la segunda instancia; aboga por suprimir la diferencia entre partes acusadoras y acusadas para la fundamentación del recurso de apelación por contraria al derecho de igualdad del art. 14 CE; y propone la nueva redacción de varios preceptos de nuestra LECrim.
