A central question in the debate on justice in immigration is whether immigrants have a right to stay; this book argues that liberal-democratic receiving states should also grant migrants a right not to stay. This claim runs against the presumption that migrants always desire to move on a permanent basis and intend to forge a completely new life in the country of destination. From this perspective, temporary migration is always a second-best option for migrants, engendered by the closed and often punitive migration policies of receiving countries. This book's innovative focus on the right not to stay is prompted instead by the realization that increasing numbers of migrants throughout the world conceive and plan their migratory experience as circumscribed in time and instrumental to goals and projects that they will pursue once back in their country of origin. These temporary migration projects are worthy of being accommodated by the receiving states as much as the migratory plans of those who resolve or aim to immigrate on a permanent basis. Accommodating them entails setting up the appropriate welfare measures and programs in the host country and, through bi-lateral agreements, in the country of return. This is especially important in view of the fact that very often the migrants who engage in temporary migration projects find themselves in a condition of high vulnerability and risk. The "right not to stay" advocated in this book is a positive and substantive right to see one's project of temporary migration-and-return protected and accommodated by institutions.

This book investigates the origins and development of human rights discourse in Finnish legal scholarship in the twentieth century. It provides a detailed account of how human rights were understood before they had legal relevance in a positivist sense, how they were adapted to Finnish legal thinking in the post-Second World War decades, how they developed into a mode of legal rhetoric and a type of legal argument during the 1970s and 1980s, and how they eventually became a significant paradigm in legal thinking in the 1990s. The book also demonstrates how rights discourse infiltrated the discussion regarding problems that were previously addressed in arguments concerning morals, social justice and equity. Although the book focuses on the history of Finnish legal scholarship, it is also interesting from a global perspective for two reasons: Firstly, it demonstrates how an idea of international law is transplanted and diffused into national legal thinking; Finland is an illustrative example in this regard. Secondly, it offers insights into the general history of human rights.

In Germanic and Nordic languages, the term for ‘public health’ literally translates to ‘people’s health’, for example Volksgesundheit in German, folkhälsa in Swedish and kansanterveys in Finnish. Covering a period stretching from the late nineteenth century to the present day, this book discusses how understandings and meanings of public health have developed in their political and social context, identifying ruptures and redefinitions in its conceptualisation. It analyses the multifaceted and interactive rhetorical play through which key concepts have been used as political tools, on the one hand, and shaped the understanding and operating environment of public health, on the other. Focusing on the blurred boundaries between the social and the medico-scientific realms, from social hygiene to population policy, Conceptualising Public Health explores the sometimes contradictory and paradoxical normative aims associated with the promotion of public health. This is an English translation of Schelling's Ideas for a Philosophy of Nature (first published in 1797 and revised in 1803), one of the most significant works in the German tradition of philosophy of nature and early nineteenth-century philosophy of science. It stands in opposition to the Newtonian picture of matter as constituted by inert, impenetrable particles, and argues instead for matter as an equilibrium of active forces that engage in dynamic polar opposition to one another. In the revisions of 1803 Schelling incorporated this dialectical view into a neo-Platonic conception of an original unity divided upon itself. The text is of more than simply historical interest: its daring and original vision of nature, philosophy, and empirical science will prove absorbing reading for all philosophers concerned with post-Kantian German idealism, for scholars of German Romanticism, and for historians of science.
