Le tracce sono i veri testimoni “silenti” del crimine. Sono sempre presenti e sono affidabili perché non possono mentire, non si dimenticano, non si confondono, non possono essere sbagliate. Solo l’errore umano nell’individuarle e studiarle può sminuirne il valore. Oggigiorno, il rischio di errori è meno accentuato rispetto al passato. La scena del crimine non è più un bacino di raccolta indifferenziata di tracce, lasciata al caso e all’esperienza dell’investigatore. Le tracce vengono ricercate, interpretate e repertate con rigore logico, metodo scientifico ed elevata tecnologia, potendo fornire un prezioso contributo alla ricostruzione del fatto. Ma l’errore è sempre possibile. Sta al processo penale e ai suoi protagonisti individuarlo. Tuttavia, il sillogismo “scena-scienza-prova penale” si rivela difficile. Il problema di fondo è che le investigazioni sul locus commissi delicti si sottraggo-no alle tradizionali regole del procedimento probatorio. Il codice di rito risulta inadeguato ad ospitare i “nuovi” prodotti tecnico-scientifici nelle dinamiche di formazione della prova penale, poco attente alla fase di ricerca della fonte di prova. I rilievi e gli accertamenti non ripetibili sfuggono alle norme e alle categorie concettuali elaborate nel 1988, finendo per proiettare al dibattimento prove precostituite sottratte al contraddittorio, che la difesa non è stata in grado di controllare né bilanciare con le investigazioni difensive. Paradigma del libro è la scena del crimine nella sua complessità ed eterogeneità alla ri-cerca di un equilibrio tra diritto e scienza. Sotto il profilo giuridico, l’attenzione è rivolta all’individuazione delle disfunzioni normative e di soluzioni interpretative percorribili che tengano conto della realtà operativa, così come della più recente giurisprudenza espressasi in materia. Sotto il profilo tecnico-scientifico, alle cautele da porre nel primo intervento di polizia giudiziaria sino alle attività CSI, attraverso la descrizione delle procedure d’intervento sulle singole tracce (fluidi biologici, vetro, fibra, ecc.), anche in scenari criminali complessi (acquatico, incendiario, ecc.), corroborate dal richiamo alle linee-guida internazionali.
