In today's organizational sociology, organizations are usually regarded as late achievements of modernity in the history of mankind. Max Weber is repeatedly cited as the supposed guarantor of this thesis. But neither his type of "bureaucratic rule" nor his concept of "rational work organization" - although both are tailored to modern conditions - contain, on closer inspection, compelling arguments for a principled limitation of organizations as such to modernity. Both actually reach their depth of focus only in contrast to "pre-modern" forms of organization. A sociology of organization that wants to refer to Max Weber's work while avoiding the numerous common misunderstandings of its reception must broaden its historical view and consider the possibility of "pre-modern organizations".

This book discusses the designs and applications of the social systems theory (built by Niklas Luhmann, 1927–1998) in relation to empirical socio-legal studies. This is a sociological and legal theory known for its highly complex and abstract conceptual apparatus. But how to change its scale in order to study more localised phenomena, and to deal with empirical data, such as case law, statutes, constitutions and regulation? This is the concern of a wide variety of scholars from many regions engaged in this volume. It focuses on methodological discussions and empirical examples concerning the innovations and potentials that functional and systemic approaches can bring to the study of legal phenomena (institutions building, argumentation and dispute-settlement), in the interface with economy and regulation, and with politics and public policies. This volume aims to revitalize the exchange between sociological differentiation theory and the sociology of religion, which previously held center stage among the sociological classics. It brings together contributions from different disciplines, as well as various forms of regional and historical expertise, which are indispensable in forming a globally oriented sociological perspective today. Secularization is understood as a process of boundary demarcation, that is, as the enactment of semantic, practical, and institutional distinctions between religion and other spheres of activity and knowledge. These distinctions may emerge from within the religious field itself, or may be absorbed into the field having originally emerged elsewhere. They may even be directly imposed upon religion by external forces. The volume is therefore based on the premise that societal differentiation – and secularity as a specific expression of it – is a widespread structural feature that nonetheless takes on various forms, depending on its historical and cultural context. In order to make this diversity visible, the volume adopts a global comparative perspective, and examines historical distinctions and differentiations in the West and beyond. By examining different forms and modes of secularity in statu nascendi, the volume contributes to developing a better understanding of the diversity of secularities, even of those found in the present day, in terms of their historicity and their specific path dependencies. With this shift in perspective, this special volume initiates a global and historical turn in the theory of differentiation, as well as in the study of secularity.
