Mario Losano è uno studioso eccellente, la cui produzione scientifica sconfina nei più disparati campi del sapere giuridico e oltre: ha arricchito le nostre conoscenze nella filosofia del diritto, nella teoria generale del diritto, nella storia del diritto, nell’informatica giuridica, nel diritto comparato, nella filosofia politica, solo per citare i settori nei quali è una riconosciuta autorità scientifica. È poi un intellettuale mosso da un’autentica passione civile e politica, e anzi un raro esempio di intellettuale: i suoi lavori spiccano per la tensione interdisciplinare, oltre che per caratteristiche decisamente poco diffuse in un mondo sempre più animato da tecnocrati dediti all’iperspecializzazione. It is a warm, austral spring Monday in the Capital of Chile. Metro stations are tingling with students and workers ready to encapsulate themselves in underground trains to commute as usual. The ticket fee has just been raised by 30 pesos. A group of young people decide to protest evading the fare. Placing their hands on the turnstile columns, one by one, they leap over the metal bar. This small gesture of disobedience spreads and intensifies with tremendous speed. On October 18, 2019, the government orders to close the entire Santiago subway. It is the day designated as the incipit of the estallido social, the Chilean social outbreak. This modest pretext is the fuse that set off a far-reaching revolt, so strong that it led the country to start a new constitutional process. The author, a direct witness to the events, recounts what unfolds before her eyes through a hybrid genre of writing: the narrative essay. Trying to penetrate the epistemic and emotional process that challenges the status quo and open up the possible, she tells and analyzes the scuffles in the streets and the inner turmoil of those who watch the wavering of known reality. Ultimately, this book is about that angry and happy, chaotic and generative time of crisis in a legal-political order. A phase that is as promising as it is often disappointing.

I due volumi constano di dodici capitoli ciascuno e tracciano una storia del cinquantennio fondativo dell’informatica giuridica attraverso i principali scritti sulla storia del calcolo anche meccanico e sull’informatica giuridica pubblicati da Mario G. Losano dal 1966 al 2014. La prefazione di Paolo Garbarino (che come rettore istituì in Italia il primo corso triennale di informatica giuridica presso l’Università del Piemonte Orientale) segue la storia accademica e personale di Losano, mentre la prefazione di Massimo Cavino sintetizza l’arco storico lungo cui si collocano i suoi scritti. Il primo volume traccia una storia del calcolo automatico e della “giuscibernetica” anche attraverso i progetti e le prime realizzazioni in Europa (compresa quella allora di là dalla Cortina di Ferro). Le bibliografie documentano il progressivo affermarsi dell’informatica nel mondo giuridico e nella pubblica amministrazione. Il secondo volume approfondisce (anche per il Giappone) l’innovazione introdotta dall’informatica nelle tecniche legislative, nonchè la trasformazione socio-giuridica connessa con le leggi sulla privacy. È concluso dalla bibliografia degli oltre 300 scritti pubblicati da Losano sull’informatica giuridica.
