Gli ordinamenti giuridici contemporanei sono caratterizzati da un alto grado di pluralismo e un forte dissenso su parecchie questioni di enorme importanza per la convivenza collettiva. Non è raro il rilievo secondo il quale tali questioni sono risolte dai Tribunali costituzionali mediante l’utilizzazione, nei frangenti decisivi delle loro argomentazioni, di elementi valutativi a carattere morale. Nel libro si affrontano alcuni tra i problemi teorici sottesi a questi temi, prendendo le mosse dalla teoria della norma di riconoscimento elaborata da Herbert Hart, per giungere infine ad alcune conclusioni concernenti l’interpretazione costituzionale vicine alla riflessione di Ronald Dworkin. La saldatura tra i contributi dei due maestri, pur notoriamente distanti tra loro, è realizzata utilizzando la teoria del diritto come pratica sociale, e ciò anche nella convinzione che essa rappresenti la strada migliore per spiegare, al tempo stesso, la normatività della costituzione e il peso che i giudizi morali hanno nella soluzione dei casi di diritto costituzionale, nonché il ruolo che, in questo contesto, assume l’ineliminabile pluralismo che caratterizza gli ordinamenti costituzionali di oggi.

L’interpretazione giuridica non è una mera presa d’atto, una duplicazione, un rispecchiamento di una realtà giuridica che le preesiste e che è da essa indipendente; l’interpretazione è, piuttosto, un elemento interno al diritto, alla cui formazione e trasformazione in qualche misura essa inevitabilmente concorre. Il diritto (il diritto positivo, l’ordinamento giuridico...) è prodotto congiuntamente dalla legislazione (ampiamente intesa) e dall’interpretazione (anch’essa ampiamente intesa); è una somma di – o meglio: una combinazione di, una continua interazione tra – fonti e norme, testi autoritativi e loro significati. L’interpretazione giuridica richiede dunque che l’interprete compia molteplici scelte, valutazioni, prese di posizione, spesso non chiaramente esplicitate; scelte che possono talvolta, o anche spesso, apparire semplicemente come questioni “tecniche”, da trattare con gli strumenti propri di un sapere specialistico, perfino ereditati da una tradizione plurimillenaria, ma che sono in larga parte, in ultima analisi, di natura etico-politica. Partendo da questi presupposti, questo libro intende portare alla luce sia il multiforme contributo apportato dall’interpretazione, e dagli interpreti, alla costruzione, alla conformazione, e alla trasformazione dell’ordinamento giuridico; sia la responsabilità in senso ampio politica che sugli interpreti ricade – e di cui talvolta non sembrano essere consapevoli nemmeno essi stessi – come conseguenza delle scelte che necessariamente essi devono prendere nello svolgimento della loro attività.

The book reflects on the issues concerning, on the one hand, the difficulty in feeding an ever- increasing world population and, on the other hand, the need to build new productive systems able to protect the planet from overexploitation. The European Union's values - enshrined in Article 2 TEU - have come under severe pressure in several Member States. In response, the Court of Justice has set a spectacular development in motion. With its ruling in Associação Sindical dos JuÃzes Portugueses it activated the Union's common values and positioned Article 2 TEU at the very heart of its jurisprudence. Turning Article 2 TEU into an operational, judicially applicable provision, the Court has begun to assess the Member States' constitutional structures against these yardsticks. Since then, the jurisprudence has evolved with remarkable speed. EU Values Before the Court of Justice provides a first comprehensive study of the judicial mobilisation of Article 2 TEU. It starts by developing the foundations of this emerging jurisprudence in empirical, doctrinal, and theoretical terms. In this book, Spieker seeks to advance a new understanding of Article 2. He argues that the provision should be understood as having a dual character that resonates between two dimensions, namely an EU dimension limited to the EU legal order and a 'Verbund' dimension that extends to the common whole of the Union and its Member States. Article 2 plays different roles in these two spheres - as thick constitutional core of the EU legal order and as thin constitutional frame for the 'Verbund'. This dual character should guide the provision's future judicial development. The book sets out to explore the multifaceted potential of Article 2 TEU in each of these two dimensions. As such, it goes far beyond the current focus on illiberal developments in Member States and strives to broaden our horizon for the judicial mobilisation of EU values. The book closes by assessing the risks of placing an activated Article 2 into the hands of Luxembourg judges and proposes ways to recalibrate the jurisprudence.
