The authors explore cutting-edge issues within each topic, and analyse current trends in law reform. Both China and Europe have a long tradition of commercial and maritime law; and this new book examining various topics from their particular perspectives is both timely and important. It links the vital component of maritime law with commercial law, financial law and trade policy. The book has performed a remarkable task in making connections between China and Europe through the lenses of substantive and procedrual laws, covering a wide range of areas, including commercial law, insurance law, salvage, EU maritime law and Brexit, carriage of goods by sea, arbitration, mediation, litigation, the recently formed China International Commercial Court, and different liability regimes, as well as a brief look forward into new initiatives and artificial intelligence in the digital age. In these challenging times, we all have much to learn from each other in seeking to find answers to what are often difficult problems. This book provides a welcome opportunity for anyone interested in commercial and maritime law to engage in that learning exercise and, looking ahead, thereby to help solve such problems as may arise in the future – in a practical and fair manner. It is therefore of great relevance to both the academic field and the legal practice field in China and Europe.

The enormous technological, financial, and structural changes of recent decades have revolutionized the international shipping industry, bringing about lower freight rates, shorter time in port and fast turnarounds, reduction in crew size, employment of cheap labour from developing countries, avoidance of national regulations and taxes, and diminished living and working standards on board. Exploitation of seafarers has always existed, but now it has become more common and frequent. Shipowners can cut costs in various ways, but the most profitable and easiest to achieve are those at the expense of labour costs, in particular costs for maintaining proper living conditions on board the ship. This bulletin examines in detail the structure of the shipping industry, focusing on problems concerning the working and living conditions of seafarers on board merchant ships serving the global sea transport system. Exploring all levels of maritime policymaking on a global and European level, the author analyses seafarers' rights in the light of international enforcement mechanisms and particularly in the light of the recent ILO Maritime Labour Convention. He also considers relevant case law, as well as advisory opinions and policy statements from various pertinent agencies, especially in the EU context.. Among the issues raised and discussed in depth in relation to their effect on seafarers' labour standards are the following: * ship manning companies; * illicit crewing agencies; * flags of convenience; * hours of work and rest; * wages; * occupational health and safety; * accommodation, food, water, and catering; * recreational facilities; * filing of grievance; and * port controls. The author shows that, expansion and progress of the maritime industry notwithstanding, there is a great need for effective enforcement mechanisms in this area. This is the first detailed analysis to connect the working and living conditions of seafarers with international, supranational, and national maritime legislation. A giant step towards establishing a global monitoring system to enforce international maritime conventions regarding seafarers' labour standards, it is sure to make an important contribution to both international labour and employment law and the law of the sea.

China S Workers Under Assault written by Anita Chan and has been published by M.E. Sharpe this book supported file pdf, txt, epub, kindle and other format this book has been release on 2001-05-15 with Business & Economics categories.

This important book contains case studies with substantive analysis of Chinese workers in a variety of settings: state enterprises, urban collectives, township and village enterprises, domestic private enterprises, and foreign funded enterprises. The cases include urban workers, migrant workers from the countryside, and workers who are sent to work outside of China. The analytical framework for these case studies lays out why labor rights violations have been occurring in China and highlights the context in which these violations operate and the extent to which these selected cases are not isolated incidents. Moreover, the dilemma of Chinese workers is put into international perspective: the context of the international labor market, the setting of competitive minimum wages in Asia, and the concern for Chinese workers' rights taken up by the International Labor Organization (ILO). This book debunks the conventional wisdom that Chinese workers are thriving because the Chinese economy is booming. Indeed the wage structures of these enterprises of different ownership types contribute to widening income disparities in China. The book uncovers what exactly the overseas Chinese entrepreneurship (Taiwan and Hong Kong), means at the factory level. And it calls for a new approach to scrutinizing the phenomena of the so-called Chinese economic miracle and its repercussions on other economies and labor markets.
