The open access publication of this book has been published with the support of the Swiss National Science Foundation. International law is increasing in relevance to the topic of secession. This book demonstrates that if a secessionist entity’s effectiveness is achieved in violation of peremptory norms, the emergence of statehood is precluded, thereby challenging a classical view of secession as purely factual and meta-legal. Dr. Júlia Miklasová coins the term “illegal secessionist entity,” demonstrates the pervasive effects of the original illegality on the subsequent relations of such entities (purported diplomatic, treaty, economic relations, acts and laws) and outlines the overlapping regimes of the law of occupation, human rights law and duty of non-recognition. Post-Soviet secessionist entities result from an illegal use of force. They are thus prohibited from becoming States, and further consequences of their illegality apply.

Non-recognized States are a widespread and politically sensitive de facto phenomenon in international politics, raising numerous questions from both a public international law and private law perspective. The present book deals with rarely analysed questions on how States deal with legal issues of private law arising with regard to non-recognized States and what issues of international trade and investment law arise in such cases. The book takes the non-recognized States that emerged in the post-Soviet area after 1990/1991 as examples, but also makes references to other non-recognized States. The book is written from a comparative perspective, giving room to authors from various States and non-recognized States (state-like entities) alike. Recent developments have led to the disappearance of three non-recognized States in the region. In this regard, the book may also be interesting as a source of information that has already disappeared or will probably soon disappear from the Internet. A Theory of De Facto States offers a new perspective on the phenomenon of de facto states — political communities that manifest forms of statehood in international politics but lack international legal recognition — zooming in on two prominent examples, Somaliland and Kosovo. Employing a thorough understanding of classical realist theories of international relations, this book provides a fresh critique of the common ways in which existing research tends to identify the ostensible state features of these communities. In contrast to the prevalent portrayals of such features in terms of international legal, discursive, and/or everyday logics, this book argues that de facto states can be most fundamentally characterised as exceptional polities in international relations. Showcasing how the statehood and sovereignty of de facto states is based in international political crises, this book concludes that these entities function as recurring disruptions of any supposed international political order. This book frames the Armenian-Azerbaijani conflict over Nagorno-Karabakh in the context of European and international security. It is the first book to focus on the politics of the conflict rather than the dispute itself. Since their emergence twenty years ago, this and other “frozen conflicts” of Eurasia have been affected by transformations in European security, and many ways absorbed into an ever fiercer geopolitical struggle for influence. The wars in Georgia and Ukraine brought greater attention to some unresolved conflicts, but not to the conflict between Armenia and Azerbaijan. As the contributors to this volume argue, the conflict merits much greater European attention, for several reasons: it is on a path of escalation, existing mediation regimes are dysfunctional, and as both Georgia and Ukraine have showed, any outbreak of serious fighting will force the EU to respond. This book explores the challenges that disinformation, fake news, and post-truth politics pose to democracy from a multidisciplinary perspective.
