This book explores sexual violence and crime in Australia in the 1970s and 1980s, a period of intense social and legal change. Driven by the sexual revolutions, second wave feminism, and ideas of the rights of the child, there was a new public interest in the sexual assault of women and children. Sexual abuse was studied, surveyed and discussed more than ever before in Australian society. Yet, despite this, there remained substantial inaction, by government, from community and on the part of individuals. This book examines several difficult questions of our recent history: why did Australia not act more firmly to eradicate rape and child sexual abuse? What prevented our culture from looking seriously at trauma? How did we fail to protect victim-survivors? Rich in social and legal history, this study takes readers into the world of victims of sexual crime, and into the wider community that had to deal with sexual violence. At the core of this book is the question that resonates deeply right now: why does sexual violence appear seemingly insurmountable, despite significant change? Lisa Featherstone is an Australian historian and Head of History in the School of Historical and Philosophical Inquiry, University of Queensland, Australia. Her work focuses on sexuality, medicine and the law. She is interested in the ways these authoritative discourses intersect around the body, in particular around sexual violence. Featherstone has published widely on sexual crimes, including child sexual abuse and rape in marriage. She is the author of two previous monographs, Let's Talk About Sex: Histories of Sexuality in Australia from Federation to the Pill, and Sex Crimes in the 1950s (co-authored with Andy Kaladelfos). The latter was shortlisted for the NSW Premier's Prize. She has published extensively in international and local journals in history and gender studies, including articles in Gender and History, Women's History Review, Feminist Legal Studies, Australian Historical Studies and The Journal of the History of Sexuality. .

This open access book examines the ways that consent operates in contemporary culture, suggesting it is a useful starting point to respectful relationships. This work, however, seeks to delve deeper, into the more complicated aspects of sexual consent. It examines the ways meaningful consent is difficult, if not impossible, in relationships that involve intimate partner violence or family violence. It considers the way vulnerable communities need access to information on consent. It highlights the difficulties of consent and reproductive rights, including the use (and abuse) of contraception and abortion. Finally, it considers the ways that young women are reshaping narratives of sexual assault and consent, as active agents both online and offline. The Australian Royal Commission into Institutional Responses to Child Sexual Abuse (2013-2017) has given national consciousness to the problematic treatment of sexual offences in Australia's past. Yet there has been little historical research into the policing, prosecution and punishment of those crimes. This book examines Australia's treatment of sexual crimes in the 1950s, a decade well known for its political and social conservatism, its prudish views on morality, and its prescriptive gender roles for men and women. Fewer would know that this same decade saw soaring arrests, mounting criminal prosecutions, and intensifying public debates about how to deal with sexual offenders. Or that sexual offences on children attracted the most concentrated state attention and public concern. Sex Crimes in the Fifties uncovers this new history by drawing on transcripts of hundreds of criminal proceedings and extensive research in criminal justice archives. We examine the criminal trial itself, exploring how prosecutors, defence counsel, witnesses, juries and judges understood sexual crimes. We consider the experience of women testifying in rape trials, the prosecution of sexual crimes against children, the court's treatment of recent immigrants, the prosecution and punishment of homosexual men, the influence of psychiatric evidence, and the increasing public debates over the 'sex offender'. We show that the 1950s was indeed foundational to many of our contemporary beliefs about sexual crimes. This book makes a major contribution to our historical and socio-legal knowledge about sexual offences and criminal prosecution. It will be of interest to historians, criminologists, sociologists, and legal scholars as well as general readers interested in the treatment of these crimes in our past.

The Royal Commission into Institutional Responses to Child Sexual Abuse (2013– 17) was one of the largest public inquiries in Australian history and one of the most important investigations into child abuse internationally. It facilitated a national conversation about justice for victims and survivors and how to improve child safety in the future. Through the examination of practices in key social institutions, including churches, schools, sporting clubs, hospitals and voluntary organisations, it provided new understandings of the widespread abuse that many people had experienced in the past and it made recommendations for a national redress scheme. The Royal Commission also recommended sweeping reforms in policies, practices and institutional cultures. In 2015, the Australian federal government proclaimed that violence against women had become a national crisis. Despite widespread social and economic advances in the status of women since the 1970s, including growing awareness and action around gender violence, its prevalence remains alarming. A third of all women in Australia have been assaulted physically; a fifth of all women have been assaulted sexually. Intimate partner violence is significantly more prevalent in Australia than western Europe or North America. One woman each week is murdered by an intimate partner, and recent research suggests that nearly forty per cent of all women who suicide have a history of domestic or family violence. Domestic violence is a precipitating factor in a third of all homelessness. The resulting strain on government services and lost productivity means that family violence has been estimated as costing the Australian economy around 13.6 billion dollars a year. The histories presented in this collection indicate exactly where these violent behaviours come from and how they have been rationalised over time, offering an important resource for addressing what amounts to a widespread, persistent, and urgent social problem.
