The ideological roots of the British Empire have been widely discussed in early modern studies, as have maritime settings in the period’s imaginative writing. However, these perspectives have not adequately accounted for how literature’s evolving representations of the common British seaman shaped the early stages of public discourse about Britain’s imperial endeavours. Filling that gap in scholarship, Ships of State argues that literary representations of seaborne labour play a distinct and crucial role in the early formation of British imperial attitudes. The book analyses these representations across an array of popular genres: New World promotion tracts, civic pageantry, stage drama, and broadside ballads. These genres demonstrate how imaginative modes of discourse both reflected and influenced popular conceptions of the common seaman and, by extension, the national ambitions he represented. Placing these depictions into dialogue with the larger national conversation about maritime expansion, Ships of State sheds new light on the role of seaborne labour and its literary representations in creating and sustaining empire.

All of these flag States have the right to sail ships flying their flag on the high seas (LOSC Article 90) ; and those ships enjo y the freedom of navigation upon the high seas (LOSC Article 87) . W ith this freedom comes a concomitant duty upon the flag State to effectively exercise its jurisdiction and control in administrative , technical , social (LOSC Article 94 (1)) and en vironmental protection (LOSC Article 217) matters over ships flying its flag. 1.2 Flag State Responsibility The absence of any authority over ships sailing the high seas would lead to chaos. One of the essential adjuncts to the principle of freedom of the seas is that a ship must fly the flag of a single State and that it is subject to the jurisdiction of that State. (Brown 1994 , p. 287) This opinion of the International Law Commission in 1956 on a draft article of the High Seas Convention (HSC) was a product of its time; a time of traditional maritime States and responsible long-established shipping companies operating for 3 the most part under the effective maritime administrations of their national flag .

This book is devoted to an examination of the legal status of govern ment merchant ships while on the high seas or in the waters of foreign states in time of peace. The object of this examination is to ascertain whether there is any rule of international law which accords such a ship a higher status than that of private merchant ships. Whether government merchant ships, unlike private ships, are entitled to certain immunities from the jurisdiction of foreign states is the question that we have set out to answer in this book. A discussion of the rules concerning the nationality of such a ship or the jurisdiction of the flag state over her does not find a place in this work. A government merchant ship may be defined as a merchant ship l owned or operated by a state. Immunity of a ship here means the exemption of a government ship from the jurisdiction of any state other than the flag state. This term also connotes the immunity of the flag state from the jurisdiction of the tribunals of foreign states in respect of proceedings connected with such a ship. Immunity of persons means the exemption of persons in the service of a govern ment ship, or other persons on board her, from the jurisdiction of any state other than the flag state.
