Doktorarbeit / Dissertation aus dem Jahr 2003 im Fachbereich BWL - Recht, Note: 1, Universität Wien, Sprache: Deutsch, Abstract: Anhand einiger Gedanken zum Vertragsrecht möchte ich aufzeigen, dass das geltende Recht von dem Bestreben getragen ist, beide Arten von Vertrauen zu schützen, sowohl das nach dem Eingehen einer Geschäftsbeziehung als auch das durch Versprechen und Signale hervorgerufenes. Dabei erfolgt diese Sicherung des Vertrauens in aller Regel entweder durch direkte Handlungsanweisungen an eine Vertragsseite, die notfalls gerichtlich erzwungen werden können, oder durch die Auferlegung von Ersatzpflichten für den Fall der Verletzung einer Norm. Im Bereich des Gewährleistungsrechts, also dem Einstehenmüssen für zugesagte Qualität, gibt es bspw. solche Vorschriften, die zum Austausch bzw. der Reparatur von Gütern verpflichten. Auch in den Regeln über die Lauterkeit des Wettbewerbs (und der Werbung) manifestieren sich direkte Anweisungen. Ergänzt wird all dies durch das allgemeine Haftpflichtrecht, welches für den Fall von Schäden, die im Zuge eines Vertragsverhältnisses entstehen, sogar besondere (gläubigerfreundliche) Sonderregeln enthalten. Auswirkungen haben diese Punkte u.a. auf die richtige Wahl der Produktionsqualität, den optimalen Einsatz von Marketingmethoden und die Effizienz des Abgehens von Versprechen, d.h. Vertragsbrüchen. Daher stelle ich im ersten Hauptteil dieser Arbeit zunächst die Grundzüge des Vertragsrechts und dessen Bedeutung für den Güteraustausch dar. Danach wird der Einsatz des Rechtsinstituts der Konventionalstrafe und die letzte Novelle des Gewährleistungsrechts auf deren Auswirkungen auf die Leistungsqualität und deren Transparenz beleuchtet, wobei ebenfalls ein Vergleich mit der Verwendung anderer Werbemethoden angestellt wird.

Using an interdisciplinary approach involving economics, sociology and law, Regulating Contracts explores fundamental questions about the purposes and effects of legal regulation of contractual relationships. What kind of social relation do contracts create, or, more precisely, how do contracts govern social interaction. How are contractual relations, or more generally, markets constructed? Since Bitcoin appeared in 2009, the digital currency has been hailed as an Internet marvel and decried as the preferred transaction vehicle for all manner of criminals.
