Penelitian ini membuktikan bahwa pelaksanaan Qanun Aceh Nomor 12, 13, dan 14 Tahun 2003 tentang khamar, maisir, dan khalwat di Kota Subulussalam belum sepenuhnya berjalan dengan baik, karena selain masalah hukum qanunqanun, kebanyakan mempunyai upaya konsolidasi politik pemerintah pusat maupun pemerintah daerah. Tesis ini mendukung dan menguatkan kesimpulan dari Michail Buehrel dalam artikelnya yang berjudul The Rise of Shari’a by-Laws in Indonesian Districts an Indication for Changing Patterns of Power Accumulation and Political Corruption, (2008) yang berpendapat bahwa formalisasi syariat Islam di daerah merupakan alat konsolidasi politik penguasa lokal terutama untuk mengeksplorasi finansial dalam membangun, Buehler bahkan tidak menemukan gerakan konservatisme dalam pemberlakuan syariat Islam di daerah. Penelitian ini juga mendukung pendapat M.B Hooker dalam karyanya berjudul Indonesian Syariah: Defining a National School of Islamic Law, (2008) yang menyatakan bahwa dalam proses legislasi syariat Islam di Aceh terdapat banyak kendala dan hambatan, karena hukum syariat yang ingin diterapkan mestilah sesuai dengan sistem hukum nasional, sementara Pemerintah Pusat menambah lagi keluasan otonomi bagi Aceh di bidang hukum Islam untuk melegislasi qanun syariat di bidang jina>ya>t. Tesis ini tidak sependapat dengan kesimpulan Harold Crouch dalam karyanya The Recent Resurgence of Political Islam in Indonesia, “Islam In Southeast Asia: Analysing Recent Development”, ed. Anthony L. Smith, (Singapore: ISEAS, 2002) yang mengatakan bahwa rentetan sejarah kegagalan partai Islam dalam upaya menerapkan syariat Islam membuat peluang untuk penerapan syariat Islam di Indonesia sama sekali tidak ada. Pendapat Crouch hanya mengatakan kalau penerapan syariat Islam harus dalam arti mendirikan negara Islam. Data diperoleh dari penelitian lapangan (field research) dengan metode kualitatif dan menggunakan pendekatan sosio-legal-historis. Data primer berupa dokumen dan hasil waawancara serta observasi lapangan. Data primer dalam bentuk dokumen adalah: UU No. 44 Tahun 1999, UU No. 18 Tahun 2001, UU No. 11 Tahun 2006, Qanun No. 5 Tahun 2000, Qanun Nomor 12, 13, 14 Tahun 2003, Qanun No. 7 Tahun 2013, Qanun No. 6 Tahun 2014 dan Qanun No. 8 Tahun 2014. Adapun data primer dalam bentuk hasil wawancara dan observasi bersumber dari: Kantor Dinas Syariat Islam (DSI), Wilayatul Hisbah (WH), Mahkamah Syar’iyah (MS), Kepolisian, Majelis Permusyawaratan Ulama (MPU), Majelis Adat Aceh (MAA). Data skunder berupa: 1) buku-buku mengenai hukum Islam, sosiologi dan antropologi hukum, sejarah perkembangan Islam di Indonesia; 2) Jurnal-jurnal dan karya ilmiah lainnya yang mengkaji tentang hukum Islam, penerapan syariat Islam, sosial dan kemasyarakatn; 3) serta sumber-sumber lain yang relevan seperti, makalah-makalah ilmiah, website, surat kabar, majalah dan lain-lain.
