The process of construction of national states had a decisive moment during the period of revolutions that spanned from the end of the eighteenth century until the mid-nineteenth century. Even if it was a generalized process throughout the Western world, the majority of social scientists that have analyzed it have based their theoretical models on the European and North American experiences. This volume pays particular attention to the historical experience of Latin America and accounts for its distinctive regional and national characteristics through the analysis of cases. It also evokes the existence of certain features of the process that historiography has not sufficiently taken into consideration until now. This book provides the first detailed perspective of the formation of the State’s bureaucracies in Latin America, a long and complex process shaped by the political, economic, social, and cultural conditions of different countries in the continent. These bureaucracies absorbed and institutionalized the pre-existing configurations of power while simultaneously transforming them. The essays included in this book offer an innovative vantage point for the analysis of issues that continue to be crucial in present-day Latin America, such as those that involve the relations between the State and society.

O mundo tem se unificado em prol de demandas sociais e os Direitos Humanos se apresentam como elemento que guia essa inter-relação global. O modelo de Estado Soberano até então concebido já não representa os ideais globais onde a transnacionalidade passa a ser uma característica inevitável na formação e atuação dos Estados. Ademais, as crescentes modificações relacionais entre indivíduos e povos, decorrentes do desenvolvimento significativo das tecnologias de informação e comunicação, abrem espaço para novas perspectivas no campo da soberania e dos Direitos Humanos. As discussões sobre soberania do Estado ganham destaque na medida em que se avança no século XXI e com o conflito de paradigmas sociais estatais. O discurso da soberania do Estado promove um afastamento de influências externas no território e na política do Estado, mas esse discurso também é capaz de acobertar violações de Direitos Humanos. Este trabalho possui objetivo de revelar os limites impostos à soberania do Estado decorrentes das concepções contemporâneas de mundo que envolvem políticas nacionais e internacionais de promoção e proteção aos Direitos Humanos. As reflexões apresentadas permitem abstrair que os Direitos Humanos são como um eixo delimitador da soberania do Estado.

As fontes de Direito são frequentemente perspetivadas de um ponto de vista gradual, piramidal e hierárquico, com base num enfoque clássico, tipicamente Kelseniano. Porém, procura-se aqui demonstrar que os ordenamentos jurídicos contemporâneos devem ser perspetivados de acordo com um enfoque mulitinível, considerando diferentes tipos de relações e interações normativas (não apenas hierárquicas ou de escalonamento, mas igualmente relações de paridade e de circularidade ou auto-referencialidade). Sources of law are often presented from a hierarchical and pyramidal point of view, based on a traditional Kelsenian approach. However, in this book (doctoral thesis), I argue that contemporary legal orders shall be considered multilevel arrangements, comprising several types of legal links, relations and interactions (not only hierarchy, but also parity and self-reference).

O país guarda muitas semelhanças com o Brasil, e entender as lições daquele país quanto ao tratamento do tema das drogas e do tráfico internacional é poder também pensar sobre os mesmos problemas no Brasil. O resultado final que aqui se chega é de que a Guerra às Drogas não tem sucesso e que novas formas de tratamento com o tema precisam ser desenvolvidos.
