La situación carcelaria en los países de América Latina y el Caribe al filo del año 2001 es de extrema gravedad.Analizados los casos de veintiséis países se observa que los sistemas penitenciarios de veinticinco de ellos se encuentran sobrepoblados, y el restante funcionando al 100% de su incapacidad, y que veinte de los veintiséis presentan niveles de sobrepoblación crítica superiores al 120%, lo que obstaculiza el normal desempeño de funciones esenciales como salud, descanso, higiene, alimentación, régimen de visitas y seguridad, con tasas de muertes violentas intracarcelaria -homicidios y suicidios- que superan varias veces las de la vida en libertad. Sobrepoblación significa que hay más de una persona donde hay espacio sólo para una, lo que es una pena cruel, inhumana o degradante, como lo establece la Convención de las Naciones Unidas contra la tortura y otros tratos o penas crueles, inhumanos o degradantes, y, paradójicamente, tal situación es el resultado del accionar de la justicia, que tiene a su cargo la salvaguarda de los derechos fundamentales. Este libro, escrito por reconocidos especialistas, presenta la evolución de los sistemas penitenciarios de América Latina y el Caribe durante el útlimo decenio, su situación actual y proyección futura, recoge información y experiencias de Europa y América del Norte, y sugiere las respuestas concretas posibles para una situación que se agravará en el corto y mediano plazo. Es de lectura indispensable para quienes tienen responsabilidad en materia de política criminológica o son operadores de los sistemas de justicia penal.

Actualmente somos alrededor de 6000 millones, viviendo la mayor parte en países subdesarrollados, sin la adecuada educación y sin los satisfactores necesarios para su desarrollo. Se calcula que para el año 2025, la población mundial llegará a 8500 millones de seres humanos, viviendo en condiciones como no había ocurrido jamás, porque ese crecimiento desorbitado no correrá paralelo a la capacidad de educar y atender a tan enorme cantidad de personas.
