Social ontology, in its broadest sense, is the study of the nature of social reality, including collective intentions and agency. The starting point of Tuomela's account of collective intentionality is the distinction between thinking and acting as a private person ("I-mode") versus as a "we-thinking" group member ("we-mode"). The we-mode approach is based on social groups consisting of persons, which may range from simple task groups consisting of a few persons to corporations and even to political states. Tuomela extends the we-mode notion to cover groups controlled by external authority. Thus, for instance, cooperation and attitude formation are studied in cases where the participants are governed "from above" as in many corporations. The volume goes on to present a systematic philosophical theory related to the collectivism-versus-individualism debate in the social sciences. A weak version of collectivism (the "we-mode" approach) depends on group-based collective intentionality. We-mode collective intentionality is not individualistically reducible and is needed to complement individualistic accounts in social scientific theorizing. The we-mode approach is used in the book to account for collective intention and action, cooperation, group attitudes, and social practices and institutions, as well as group solidarity. Tuomela establishes the first complete theory of group reasons (in the sense of members' reasons for participation in group activities). The book argues in terms of game-theoretical group-reasoning that the kind of weak collectivism that the we-mode approach involves is both conceptually and rational-functionally different from what an individualistic approach ("pro-group I-mode" approach) entails.

This collection brings together a carefully curated selection of researchers from law, sociology, anthropology, philosophy, history, social ontology and international relations, in order to examine how law and custom interact within specific material and spatial contexts. Normativity develops within these contexts, while also shaping them. This complex relationship exists within all physical places from traditional agrarian spaces to the modern shifting post-industrial workplace. The contributions gathered together in this volume explore numerous examples of such spaces from different disciplinary perspectives to interrogate the dynamic relationship between custom and law, and the material spaces they inhabit. While there are a dynamic series of conclusions regarding this relationship in different material realities, a common theme is pursued throughout: a proper understanding of law and custom stems from their material locatedness within the power dynamics of particular spaces, which, in turn, are reflexively shaped by that same normativity. The book thus generates an account of the locatedness of law and custom, and, indeed, of custom as a source of law. In this way, it provides a series of linked explorations of normative spaces, but, more fundamentally, it also furnishes a cross-disciplinary toolkit of concepts and critical tools for understanding law and custom, and their relationship. The field of socio-legal research has encountered three fundamental challenges over the last three decades – it has been criticized for paying insufficient attention to legal doctrine, for failing to develop a sound theoretical foundation and for not keeping pace with the effects of the increasing globalization and internationalization of law, state and society. This book examines these three challenges from a methodological standpoint. It addresses the first two by demonstrating that legal sociology has much to say about justice as a kind of social experience and has always engaged theoretically with forms of normativity, albeit on its own empirical terms rather than on legal theory’s analytical terms. The book then explores the third challenge, a result of the changing nature of society, by highlighting the move from the industrial relations of early modernity to the post-industrial conditions of late modernity, an age dominated by information technology. It poses the question whether socio-legal research has sufficiently reassessed its own theoretical premises regarding the relationship between law, state and society, so as to grasp the new social and cultural forms of organization specific to the twenty-first century’s global societies.

Derrida's Social Ontology: Institutions in Deconstruction presents the first dedicated study of Jacques Derrida’s philosophy of institutions. While previous studies of Derrida’s thought have considered his engagement with individual institutions—from the university to literature, law, and psychoanalysis, among others—Derrida’s Social Ontology offers the first attempt to reconstruct and defend the philosophical theory of institutions that underlies these engagements. In so doing, the book argues that the theme of “the institution” in Derrida's oeuvre offers the best throughline for understanding the substantively normative significance of deconstruction as a philosophical practice, arguing that Derrida is unique among so-called “postmodern” thinkers in providing an account of the relationship between the historically contingent character of institutions and the normative entitlements that such entities make possible. Specifically, the book shows how Derrida accounts for this relationship in a way that leaves room for a notion of “unconditional responsibility” for the social and political world to the extent that the latter is structured by perfectible institutions. In tracing the development of Derrida’s account of this link between the historicity and normativity of institutional life—from his early writings on the historicity of the institution of philosophy, to his later critiques of practices of institutional cruelty like the death penalty—Derrida's Social Ontology not only offers readers a new framework for making sense of the normative commitments that defined this philosopher's writings, but will also establish the terms for putting his works into conversation with contemporary debates in social and political philosophy and critical theory more broadly.
