This book presents a distinctive approach to the study of law in society, focusing on the sociological interpretation of legal ideas. It surveys the development of connections between legal studies and social theory and locates its approach in relation to sociolegal studies on the one hand and legal philosophy on the other. It is suggested that the concept of law must be re-considered. Law has to be seen today not just as the law of the nation state, or international law that links nation states, but also as transnational law in many forms. A legal pluralist approach is not just a matter of redefining law in legal theory; it also recognizes that law's authority comes from a plurality of diverse, sometimes conflicting, social sources. The book suggests that the social environment in which law operates must also be rethought, with many implications for comparative legal studies. The nature and boundaries of culture become important problems, while the concept of multiculturalism points to the cultural diversity of populations and to problems of fragmentation, or perhaps to new kinds of unity of the social. Theories of globalization raise a host of issues about the integrity of societies and about the need to understand social networks and forces that extend beyond the political societies of nation states. Through a range of specific studies, closely interrelated and building on each other, the book seeks to integrate the sociology of law with other kinds of legal analysis and engages directly with current juristic debates in legal theory and comparative law.

A conference called 'Ethno-historical Models and the Evolution of Law' was held in Milan and at Bellagio, Lake Como, Italy, from August 10 to August 18, 1985. The Wenner-Gren Foundation for Anthropological Research and the Rockefeller Foundation provided funding. The conference was organized by June Starr of the Department of Anthropology, State University of New York at Stony Brook, and Jane F. Collier of the Department of Anthropology, Stanford University. The goal was to compare case studies of legal change in particular societies using historical frameworks in order to search for shared questions and methodologies to direct future research. The twenty anthropologists, sociologists, and law professors from North America and Europe who attended devoted five half-days to discussing seventeen previously circulated papers and four half-days to a general consideration of conference issues. In their discussions, participants focused on the models they were using to analyze the development, change, decay, integration, and articulation of legal systems within specific social units. Professors Elizabeth Colson and William Twining served as commentators, Jessica Kuper was editorial adviser, and Longina Jakubowska and Richard Maddox were rapporteurs.

There is a myth that lingers around legal education in many democracies. That myth would have us believe that law students are admitted and then succeed based on raw merit, and that law schools are neutral settings in which professors (also selected and promoted based on merit) use their expertise to train those students to become lawyers. Based on original, empirical research, this book investigates this myth from myriad perspectives, diverse settings, and in different nations, revealing that hierarchies of power and cultural norms shape and maintain inequities in legal education. Embedded within law school cultures are assumptions that also stymie efforts at reform. The book examines hidden pedagogical messages, showing how presumptions about theory’s relation to practice are refracted through the obfuscating lens of curricula. The contributors also tackle questions of class and market as they affect law training.
