Can a soldier be held responsible for fighting in a war that is illegal or unjust? This is the question at the heart of a new debate that has the potential to profoundly change our understanding of the moral and legal status of warriors, wars, and indeed of moral agency itself. The debate pits a widely shared and legally entrenched principle of war - that combatants have equal rights and equal responsibilities irrespective of whether they are fighting in a war that just or unjust - against a set of striking new arguments. These arguments challenge the idea that there is a separation between the rules governing the justice of going to war (the jus ad bellum) and the rules governing what combatants can do in war (the jus in bello). If ad bellum and in bello rules are connected in the way these new arguments suggest, then many aspects of just war theory and laws of war would have to be rethought and perhaps reformed. This book contains eleven original and closely argued essays by leading figures in the ethics and laws of war and provides an authoritative treatment of this important new debate. The essays both challenge and defend many deeply held convictions: about the liability of soldiers for crimes of aggression, about the nature and justifiability of terrorism, about the relationship between law and morality, the relationship between soldiers and states, and the relationship between the ethics of war and the ethics of ordinary life. This volume offers an interdisciplinary study of how different cultures have sought to transform individuals into warriors. War changes people, however a less explored question is how different societies want people to change as they are turned into warriors. When societies go to war they recognize that a boundary is being crossed. The participants are expected to do things that are otherwise prohibited, or at least governed by different rules. This edited volume analyses how different cultures have conceptualized the transformations of an individual passing from a peacetime to a wartime existence to become an active warrior. Despite their differences, all societies grapple with the same question: how much of the individual’s peace-self should be and can be retained in the state of war? The book explores cases such as the Nordic berserkers, the Japanese samurai, and European knights, as well as modern soldiers in Germany, Liberia, and Sweden. It shows that archaic and modern societies are more similar than we usually think: both kinds of societies use myths, symbols, and rituals to create warriors. Thus, this volume seeks to redefine theories of modernization and secularization. It shows that military organizations need to take myths, symbols, and rituals seriously in order to create effective units. The American Civil War ended 152 years ago. Of the military men who served in this drama of untold suffering, little has been written about the experiences of the American Indian (indigenous) participants. Indigenous soldiers and sailors from various states served bravely for both the Union and the Confederacy. One such unit for the north was Company K of the First Michigan Sharpshooters called the all-Indian Company. Company K was unique because it was the only company in the entire sharpshooter regiment, and in all other military units in Michigan, that had only indigenous enlisted men on its roster. In Warriors in Mr. Lincolns Army, author Quita V. Shier offers a comprehensive profile study of each officer and enlisted American Indian soldier in Company K, First Michigan Sharpshooters, who served in the Civil War from 1863 to 1865. The profiles of this all-Indian Company include information taken from military service records, medical files, biographical and family data extracted from pension files, and personal interviews with some of the soldiers descendants. The profiles feature the infantrymen known as grunts, who bore the burden of fighting, and dying in this conflict, and the officers who led them into battle. Shier shares insight into who these fighting men were, who loved them, and what happened to them.
