The human rights movement in South Africa’s transition to a postapartheid democracy has been widely celebrated as a triumph for global human rights. It was a key aspect of the political transition, often referred to as a miracle, which brought majority rule and democracy to South Africa. The country’s new constitution, its Truth and Reconciliation Commission, and the moral authority of Nelson Mandela stand as exemplary proof of this achievement. Yet, less than a generation after the achievement of freedom, the status of human rights and constitutionalism in South Africa is uncertain. In government the ANC has displayed an inconsistent attitude to the protection, and advancement, of hard-won freedoms and rights, and it is not at all clear that a broader civic and political consciousness of the importance of rights is rooting itself more widely in popular culture.

Levine was a founding member of the first black taxi co-operative in South Africa, and instrumental in having hundreds of illegally fired black workers reinstated with back pay after the Johannesburg strikes of 1980. The unbanning of the African National Congress and the release of Nelson Mandela in February of 1990 cleared the way for negotiations toward a new, post-apartheid political order in South Africa. But three years later, the main parties have made little progress toward a compromise, while violence escalates in the townships. In this revealing study, Marina Ottaway examines the new conflicts emerging in South Africa, the factors influencing them, and the probable outcome. She shows that the black-on-white conflict that has made the country a pariah in the past has evolved into a much more complex state of affairs and explains that the transition is likely to take an unprecedented form. Beginning with a brief history of the events since Mandela's release, Ottaway provides a vivid account of the evolving conflict over apartheid. She discuses the complexity of conflict resolution in a country where internal and external currents work against each other, and where the struggle for power transcends any strides toward peace. Ottaway thoroughly addresses the issues involved in South Africa's transition from apartheid. Twenty years have passed since South Africans were being shot or hacked or burned to death in political conflict; and the memory of the trauma has faded. Some 20 500 people were nevertheless killed between 1984 and 1994. The conventional wisdom is that they died at the hands of a state-backed Third Force, but the more accurate explanation is that they died as a result of the people's war the ANC unleashed. As the people's war accelerated from September 1984, intimidation and political killings rapidly accelerated. At the same time, a remarkably effective propaganda campaign put the blame for violence on the National Party government and its alleged Inkatha surrogate. Sympathy for the ANC soared, while its rivals suffered crippling losses in credibility and support. By 1993 the ANC was able to dominate the negotiating process, as well as to control the (undefeated) South African police and army and bend them to its will. By mid-1994 it had trounced its rivals and taken over government. People's War shows the extraordinary success of this war in giving the ANC a virtual monopoly on power. It also shows, in part at least, the great cost at which this was achieved. Apart from the killings, the terror, and the destruction that marked the period from 1984 to 1994, the people's war set in motion forces that cannot easily be reversed. For violence cannot be turned off 'like a tap', as the ANC suggested, and neither can anarchy easily be converted into order. Anthea Jeffery holds law degrees from the University of the Witwatersrand and from Cambridge, and a doctorate in human rights law from the University of London. Her previous books include The Natal Story: Sixteen years of conflict and The Truth about the Truth Commission. Both books have been acclaimed for their meticulous and objective approach, and for breaking new ground on important and contentious issues.
