Disputes about sovereignty mainly arise in those cases where fundamental rights are infringed, or democratic participation denied, on account of the citizens' membership in certain ethno-cultural minority groups. Moreover, the fact that serious challenges to sovereignty can be detected even in ethno-culturally diverse polities, which by all standards qualify as fairly just liberal-democracies, can only mean that the complex relationship between sovereignty and the diversity challenge is in need of serious consideration and analysis. By observing sovereignty and diversity through the lens of a broader liberal-democratic doctrine, this book sets out plausible strategies to cope with the problems that evolve from this issue. Sovereignty and Diversity is divided into three parts. In Part I, various normative theories of secession are evaluated both in relation to philosophy and to political science. Furthermore, the value and possible role of the uti possidetis principle is discussed. Part II addresses the value of various other methods to accommodate population diversity as means to solve disputes over sovereignty - namely multiculturalism, federalism, and decentralization, as well as minority rights. Finally, Part III groups together three case studies - the first two dealing with the secession and partition theme, while the last one shows the potential of other, less controversial means to address tensions about sovereignty. This volume is a collection of updated papers presented at the University of Belgrade in July 2005, at the international conference "Legal and Political Solution to Disputes over Sovereignty - From Kosovo to Quebec."

Contestations over knowledge – and who controls its production – are a key focus of social movements and other actors that promote food sovereignty, agroecology and biocultural diversity. This book critically examines the kinds of knowledge and ways of knowing needed for food sovereignty, agroecology and biocultural diversity. ‘Food sovereignty’ is understood here as a transformative process that seeks to recreate the democratic realm and regenerate a diversity of autonomous food systems based on agroecology, biocultural diversity, equity, social justice and ecological sustainability. It is shown that alternatives to the current model of development require radically different knowledges and epistemologies from those on offer today in mainstream institutions (including universities, policy think tanks and donor organizations). To achieve food sovereignty, agroecology and biocultural diversity, there is a need to re-imagine and construct knowledge for diversity, decentralisation, dynamic adaptation and democracy. The authors critically explore the changes in organizations, research paradigms and professional practice that could help transform and co-create knowledge for a new modernity based on plural definitions of wellbeing. Particular attention is given to institutional, pedagogical and methodological innovations that can enhance cognitive justice by giving hitherto excluded citizens more power and agency in the construction of knowledge. The book thus contributes to the democratization of knowledge and power in the domain of food, environment and society. This paper claims that in the case of England, state and nation building went hand in hand resulting in an early English nation-state. The rise of a national consciousness as well as the establishment of a sovereign state protecting individual rights would not have been possible without the early formation of parliament. Therefore, this paper argues that the evolvement of Parliament was essential and played a crucial role in shaping England into a nation state.

The United Nations system's foundational principle of sovereign equality reflects persistent disagreement within its membership as to what constitutes a legitimate and just internal public order. While the boundaries of the system's pluralism have narrowed progressively in the course of the United Nations era, accommodation of diversity in modes of internal political organization remains a durable theme of the international order. This accommodation of diversity underlies the international system's commitment to preserving a state's territorial integrity and political independence, sometimes at the expense of efforts to establish a universal justice that transcends territorial boundaries. Efforts to establish a universal justice, however, need to heed the dangers of allowing powerful states to invoke universal principles to rationalize unilateral (and often self-serving) impositions upon weak states. The inspiration for this book comes from negotiations that are taking place under the auspices of the United Nations by an intergovernmental conference for a new International Legally Binding Instrument (ILBI) under the United Nations Convention on the Law of the Sea (UNCLOS) on the conservation and sustainable use of marine biological diversity of Areas Beyond National Jurisdiction (ABNJ). The proposed ILBI is attempting to fill existing gaps under international law over marine biodiversity and Marine Genetic Resources (MGR) in ABNJ. One way it is attempting to do this is by having an Access and Benefit-Sharing (ABS) schema over these resources in ABNJ that the United Nations Convention on Biological Diversity (CBD) and its Nagoya Protocol (NP) do not currently cover. These existing frameworks that regulate genetic resources are grounded in the notion of sovereignty. Effectively, States have sovereign rights over their biological resources. The ILBI, however, is attempting to regulate marine biodiversity and MGR in ABNJ. Thus, the notion that negotiators representing nation States under the auspices of the United Nations can regulate ABNJ is paradoxical – are these areas beyond nation States’ jurisdiction or not? Implicitly, the negotiators are acting as though they have sovereignty over resources located in what has been historically a sovereign-free space. Thus, the purpose of this book is to investigate this paradox. Essentially, this book critiques the notion that ABNJ can actually be regulated under the auspices of the United Nations by nation-State negotiators.
