In Islands of Sovereignty, anthropologist and legal scholar Jeffrey S. Kahn offers a new interpretation of the transformation of US borders during the late twentieth century and its implications for our understanding of the nation-state as a legal and political form. Kahn takes us on a voyage into the immigration tribunals of South Florida, the Coast Guard vessels patrolling the northern Caribbean, and the camps of Guantánamo Bay—once the world’s largest US-operated migrant detention facility—to explore how litigation concerning the fate of Haitian asylum seekers gave birth to a novel paradigm of offshore oceanic migration policing. Combining ethnography—in Haiti, at Guantánamo, and alongside US migration patrols in the Caribbean—with in-depth archival research, Kahn expounds a nuanced theory of liberal empire’s dynamic tensions and its racialized geographies of securitization. This book examines how states justify the creation of physical, policy and legislative barriers of entry for migrants by drawing on a concept of sovereignty. The movement of people across the world in search of refuge from persecution, war and poverty is accelerating. And as states confronted with this movement create physical, policy and legislative barriers to entry, they justify this exclusion by drawing on concepts of sovereignty. This book interrogates that justification in an historical and theoretical context using the case study of Australian law and policy since 1900, as well as instances from other Western countries that have routinely copied from Australia. But just as Australian migration polices are being replicated in the US, Britain and Europe, so, this book argues, is their employment of an anachronistic concept of sovereignty: one that is reasserted precisely because of its waning power in the face of globalisation. Anthropologists, historians, legal scholars, and sociologists consider not only the physical expulsion of noncitizens but also the social discipline and labor subordination resulting from deportability, the threat of forced removal. They explore practices and experiences of deportation in regional and national settings from the U.S.-Mexico border to Israel, and from Somalia to Switzerland. They also address broader questions, including the ontological significance of freedom of movement; the historical antecedents of deportation, such as banishment and exile; and the development, entrenchment, and consequences of organizing sovereign power and framing individual rights by territory. FOREWORD The International Organization for Migration (IOM) is dedicated to promoting humane and orderly migration worldwide by serving the policy and programme needs of governments and migrants. The challenges of migration management reflect the contemporary challenges posed by migration itself, many of which can be turned into opportunities that can benefit countries of origin, countries of d- tination and migrants themselves. To be effectively managed, migration has to be looked at comprehensively, taking into account its economic, social, humanit- ian, demographic, development, security and normative aspects. The normative approach to migration can be viewed mainly from two dif ferent, but complementary angles. Firstly, there are the principles and standards deriving from State sovereignty, among which are the right to protect borders, to confer nationality, to admit and expel foreigners, to combat trafficking and smuggling and to safeguard national security. Secondly, there are the human rights of the persons involved in migration. Sovereignty Experiments tells the story of how authorities in Korea, Russia, China, and Japan—through diplomatic negotiations, border regulations, legal categorization of subjects and aliens, and cultural policies—competed to control Korean migrants as they suddenly moved abroad by the thousands in the late nineteenth century. Alyssa M. Park argues that Korean migrants were essential to the process of establishing sovereignty across four states because they tested the limits of state power over territory and people in a borderland where authority had been long asserted but not necessarily enforced. Traveling from place to place, Koreans compelled statesmen to take notice of their movement and to experiment with various policies to govern it. Ultimately, states' efforts culminated in drastic measures, including the complete removal of Koreans on the Soviet side. As Park demonstrates, what resulted was the stark border regime that still stands between North Korea, Russia, and China today. Skillfully employing a rich base of archival sources from across the region, Sovereignty Experiments sets forth a new approach to the transnational history of Northeast Asia. Immigration is one of the most polarizing issues in contemporary politics. It raises questions about identity, economic well-being, the legitimacy of state power, and the boundaries of membership and justice. How should we think about immigration and what policies should democratic societies pursue? Some contend that borders should generally be open and people should be free to migrate in search of better lives. Others insist that governments have the right to unilaterally close their borders and should do so. In Immigration and Democracy, Sarah Song develops an intermediate ethical position that takes seriously both the claims of receiving countries and the claims of prospective migrants. She argues that political membership is morally significant, even if morally arbitrary. Political membership grounds particular rights and obligations, and a government may show some partiality toward the interests of its members. Yet, we also have universal obligations to those outside our orders. Where prospective migrants have urgent reasons to move, as in the case of refugees, their interests may trump the less weighty interests of members. What is required is not open or closed borders but open doors. An accessible ethical framework that clarifies and deepens the ideas with which members of democratic societies can debate immigration, Immigration and Democracy considers the implications of a realistically utopian theory for immigration law and policy.
