Mit nun 149 Mitgliedsstaaten ist ein Großteil der Weltbevölkerung an diesem System beteiligt. Globalisierung bedeutet aber nicht automatisch Wirtschaftswachstum, Wohlstandsmehrung oder gar soziale Sicherheit weltweit. Das multilaterale Handelssystem birgt Chancen und Risiken und gerade die soziale Komponente wurde in der Vergangenheit häufig vernachlässigt. Führende Industiestaaten oder aufstrebende Schwellenländer – allen voran die USA, China oder Indien – haben internationale Abkommen über soziale Rechte nicht ratifiziert oder umgesetzt und fühlen sich von Wissenschaftlern bestätigt, die der Ansicht sind, dass Wachstum einer Volkswirtschaft automatisch zu besseren Arbeitsbedingungen oder Umweltschutz führt. Doch die Praxis der vergangenen Jahre zeigt zumindest eine Problematik in diesem Bereich. Verschiedene unilaterale oder multilaterale Ansätze sind möglich, um das Handelssystem gerechter zu gestalten und möglichst viele Menschen von der Globalisierung profitieren zu lassen. Eine wichtige Rolle spielen dabei die beiden Handelsmächte USA und EU, sowie internationale Organisationen wie die WTO und die Internationale Arbeitsorganisation (International Labour Organization – ILO). Diese Arbeit beschäftigt sich mit der Rolle der EU bei der Durchsetzung internationaler Sozialstandards, sowie insbesondere der Frage nach der Bedeutung von Sozialklauseln in den Konzepten der EU. Dafür werden zunächst im zweiten Kapitel der Arbeit für die Untersuchung wichtige Begriffe näher definiert. Es folgt im dritten Kapitel ein historischer Überblick der beiden relevanten Politikfelder Handels- und Menschenrechtspolitik. Daran anschließend thematisiert das vierte Kapitel der Arbeit das Handelssystem der EU und die Bedeutung unilateraler Sozialklauseln in diesem Kontext. Das fünfte Kapitel beinhaltet das internationale Handelssystem und die Frage nach multilateralen Sozialklauseln. Im sechsten Kapitel der Arbeit werden darüber hinaus noch alternative Konzepte zur Durchsetzung von internationalen Sozialstandards vorgestellt, bevor im siebten und letzten (inhaltlichen) Kapitel ein Fazit gezogen wird.

Um das volle Ausmaß von internationalen Sozialstandards zu erfassen beleuchten wir die ILO, die Internationale Arbeitsorganisation, die sich bis dato mit dieser Thematik beschäftigte, Normen ausarbeitete, sowie die Ratifizierung und Einhaltung der Verträge überwachte. Nach der Darstellung von Verletzungen gegen bestehende Sozialstandards beginnen wir die Debatte um die viel diskutierte Lösung dieses Problems - der Einführung von Sozialklauseln in internationale Handelsverträge. Diese wird veranschaulicht durch die Darstellung handelstheoretischer Standpunkte, der neo-klassischen und der neo-institutionellen Sicht, sowie Argumente zweier Menschenrechtsorganisationen, namentlich FIAN und Misereor. Mit unserer Arbeit beabsichtigen wir einen Überblick über diese vielschichtige Materie zu geben in dem wir die verschiedenen Sichtweisen anführen - wir können aber keine Patentlösung zu dieser Thematik anbieten, da selbst die Literatur und die geführten Diskussionen zum Thema enorm gespalten sind. Dennoch stehen in diesen Ländern auch Produkte aus Staaten zum Verkauf, in denen diesem Arbeiterschutz nur eine untergeordnete oder gar keine Bedeutung zukommt.1 Diese paradox anmutende Situation, seit Jahren vielfach öffentlich kritisiert, wird von Menschenrechtsorganisationen2 und Forschern verschiedener Disziplinen als Folge von Globalisierungsprozessen verstanden. Durch die rapide Vermehrung und Verdichtung grenzüberschreitender gesellschaftlicher Interaktionen nutzen immer mehr Unternehmen die Möglichkeit, das mobil gewordene Kapital in Regionen zu investieren, in denen sie aufgrund günstigerer Arbeitskräfte und des Fehlens sozialer Standards die maximale Rendite erzielen können.3 Es sind aber vor allem jene Länder, in die das Kapital von Unternehmen aus Industrienationen fließt, die Sozialstandards im Sinne von Arbeiterrechten vielfach nicht beachten. Daher ist die Durchsetzung von internationalen Sozialstandards stets auch eine Komponente des Nord-Süd- Konfliktes, der unter anderem in der ungleichen Wirtschaftskraft der jeweiligen Länder begründet ist.4 Industrienationen sowie Entwicklungs- und Schwellenländer konkurrieren auf dem internationalen Wirtschaftsmarkt. Das Problem der Missachtung internationaler Sozialstandards ist daher eng mit globaler Wirtschaftspolitik im Kontext der Globalisierung verknüpft. Trotz des skizzierten aktuellen Zusammenhangs der unbefriedigenden Einhaltung internationaler Arbeiterrechte gehen die ersten Versuche zur Formulierung und Durchsetzung dieser Normen bereits auf die Zeit der Industrialisierung zurück. Die Gründung der International Labour Organisation (ILO) nach dem ersten Weltkrieg war einer der ersten multilateralen Lösungsansätze auf internationaler Ebene und löste die vorangegangenen bilateralen Lösungsansätze ab.5 Es folgten weitere Maßnahmen6, so z.B. in jüngerer Vergangenheit der Global Compact, der sich an multinationale Unternehmen wendet und eine freiwillige Einhaltung von Umwelt- und Sozialstandards dieser Unternehmen unter Aufsicht der United Nations (UN) vorsieht.7 Die Bilanz der bisher unternommenen Maßnahmen hat zwar zu einem hohen Grad der internationalen Normierung von Sozialstandards geführt, jedoch die Einhaltung dieser Standards nicht im selben Maße erreicht. Die Analyse der Hintergründe dieser Entwicklung ist Aufgabe dieser Arbeit.
