Terence Cuneo develops a novel line of argument for moral realism. The argument he defends hinges on the normative theory of speech, according to which speech acts are generated by an agent's altering her normative position with regard to her audience, gaining rights, responsibilities, and obligations of certain kinds. Some of these rights, responsibilities, and obligations, Cuneo suggests, are moral. And these moral features are best understood along realist lines, in part because they explain how it is that we can speak. If this is right, a necessary condition of being able to speak is that there are moral rights, responsibilities, and obligations of a broadly realist sort.

Although listening is central to human interaction, its importance is often ignored. In the rush to speak and be heard, it is easy to neglect listening and disregard its significance as a way of being with others and the world. Drawing upon insights from phenomenology, linguistics, philosophy of communication, and ethics, Listening, Thinking, Being is both an invitation and an intervention meant to turn much of what readers know, or think they know, about language, communication, and listening inside out. It is not about how to be a good listener or the numerous pitfalls that stem from the failure to listen. Rather, the purpose of the book is, first, to make readers aware of the value and importance of listening as a fundamental human ability inextricably connected with language and thought; second, to alert readers to the complexity of listening from personal, cultural, and philosophical perspectives; and third, to offer readers a way to think of listening as a mode of communicative action by which humans create and abide in the world. Lisbeth Lipari brings together historical, literary, intercultural, scientific, musical, and philosophical perspectives, as well as a range of her own personal experiences, to produce this highly readable analysis of how “the human experience of being as an ethical relation with others . . . is enacted by means of listening.”

Every liberal democracy has laws or codes against hate speech, except the United States. For constitutionalists, regulation of hate speech violates the First Amendment and damages a free society. Against this absolutist view, the author argues that hate speech should be regulated as part of our commitment to human dignity and to inclusion and respect for members of vulnerable minorities. Causing offense, by depicting a religious leader as a terrorist in a newspaper cartoon, for example, is not the same as launching a libelous attack on a group's dignity, according to the author, and it lies outside the reach of law. But defamation of a minority group, through hate speech, undermines a public good that can and should be protected: the basic assurance of inclusion in society for all members. A social environment polluted by anti-gay leaflets, Nazi banners, and burning crosses sends an implicit message to the targets of such hatred: your security is uncertain and you can expect to face humiliation and discrimination when you leave your home. Free-speech advocates boast of despising what racists say but defending to the death their right to say it. The author finds this emphasis on intellectual resilience misguided and points instead to the threat hate speech poses to the lives, dignity, and reputations of minority members. Finding support for his view among philosophers of the Enlightenment, he asks us to move beyond knee-jerk American exceptionalism in our debates over the serious consequences of hateful speech.

Hate Speech Law written by Alex Brown and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015-03-05 with Philosophy categories.
Hate speech law can be found throughout the world. But it is also the subject of numerous principled arguments, both for and against. These principles invoke a host of morally relevant features (e.g., liberty, health, autonomy, security, non-subordination, the absence of oppression, human dignity, the discovery of truth, the acquisition of knowledge, self-realization, human excellence, civic dignity, cultural diversity and choice, recognition of cultural identity, intercultural dialogue, participation in democratic self-government, being subject only to legitimate rule) and practical considerations (e.g., efficacy, the least restrictive alternative, chilling effects). The book develops and then critically examines these various principled arguments. It also attempts to de-homogenize hate speech law into different clusters of laws/regulations/codes that constrain uses of hate speech, so as to facilitate a more nuanced examination of the principled arguments. Finally, it argues that it is morally fitting for judicial and legislative judgments about the overall warrant of hate speech law to reflect principled compromise. Principled compromise is characterized not merely by compromise over matters of principled concern but also by compromise which is itself governed by ideals of moral duty or civic virtue (e.g., reciprocity, equality, and mutual respect). Most liberal societies are deeply committed to free speech, but there is evidence that some kinds of speech can be harmful in ways that are detrimental to important liberal values, such as social inequality. This volume draws on a range of approaches in order to explore the problem and determine what ought to be done about allegedly harmful speech.

Freedom of speech and extremism in university campuses are major sources of debate and moral panic in the United Kingdom today. In 2018, the Joint Committee on Human Rights in Parliament undertook an inquiry into freedom of speech on campus. It found that much of the public concern is exaggerated, but identified a number of factors that require attention, including the impact of government counter-terrorism measures (the Prevent Duty) and regulatory bodies (including the Charity Commission for England and Wales) on freedom of speech. This book combines empirical research and philosophical analysis to explore these issues, with a particular focus on the impact upon Muslim students and staff. It offers a new conceptual paradigm for thinking about freedom of speech, based on deliberative democracy, and practical suggestions for universities in handling it. Topics covered include: The enduring legacy of key thinkers who have shaped the debate about freedom of speech The role of right-wing populism in driving moral panic about universities The impact of the Prevent Duty and the Charity Commission upon Muslim students, students’ unions and university managers Students’ and staff views about freedom of speech Alternative approaches to handling freedom of speech on campus, including the Community of Inquiry This highly engaging and topical text will be of interest to those working within public policy, religion and education or religion and politics and Islamic Studies.
