The vast ocean and seas swathe an enormous space of our planet and are a crucial part of our existence. Their enigmatic depths, layers, flows, desert of waves, wilderness of water, great wide of rhythm have long been a source of fascination, awe, and fear for mankind. Therefore, it’s no surprise that there are so many interests in terms of domination, environment, space frontier, socio cultural, economic, and resources. From earliest recorded history, glory and triumph of Nusantara has depend on sea/ocean/maritime. The existence of Indonesia consists of land, sea/ocean, and air, then moulded within the socio cultural of Indonesian named Nusantara. People of Indonesia believe that the ocean/sea is not unglued between inhabitants, but it brought people together become one nation. The ocean has always been an important source of food, O2, Energy, and it has also served trade and commerce, adventure and discovery. The sea/ocean have also brought threat to Nusantara, considering the threats are mostly from/through/in the sea/ocean. Nusantara has been always magnetic many countries, it is not only because of natural resources but the geographical setting of Nusantara. Indonesia has to be glory and triumph, the key factor for Indonesia is how to control the waters, meaning Indonesia has to have capability to monitor, detect and respond issues, then utilise the sea/ocean for the interest of Indonesia. Considering economic and security matters are concerned, the need and interest of Indonesia are relatively similar to international community, user States or ships owners which are safety and security of navigation, and there is no potential damage to the environment. But for Indonesia the interest is more prominent and broader because Indonesia has to live with it if anything untoward happens in Indonesia waters. Hence, the interest of Indonesia in terms of navigational routes, straits, and choke points extend beyond economic and security. Indonesian waters is the existence of Nusantara. The book intends to explore and examine the interest of Indonesia vis a vis international laws regulate the ocean/sea and maritime matters.

Listen to the podcast with Nilufer Oral on 'Climate Change, Oceans and Gender' In Gender and the Law of the Sea a distinguished group of law of the sea and feminist scholars critically engages with one of the oldest fields of international law. While the law of the sea has been traditionally portrayed as a technical, gender-neutral set of rules, of concern to States rather than humans, authors in this volume persuasively argue that critical feminist perspectives are needed to question the underlying assumptions of ostensibly gender-neutral norms. Coming at a time when the presence of women at sea is increasing, the volume forcefully and successfully argues that legal rules are relevant to ensure gender equality and the empowerment of women at sea, in an effort to render law for the oceans more inclusive. The United Nations Convention On The Law Of The Sea written by Kristina Siig and has been published by Taylor & Francis this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023-10-09 with Law categories.

The 1982 United Nations Convention on the Law of the Sea (UNCLOS) has for four decades been considered by many to be one of the most important legislative achievements of international law. It is revered as a "constitution of the oceans", providing the legal framework for the governance of the oceans. This volume explores how the UNCLOS is functioning in various complex settings, how it adapts to new, emerging developments, as well as how it interacts with other regulation, both within the law of the sea regime and outside. Engaging in themes such as law and order at sea, UNCLOS’ interaction with human rights and the role of private actors, the book raises complex questions in the application, understanding, and enforcement of the convention and how it can be envisaged, interpreted, and used in a dynamic world. The volume also raises methodological questions, the answers to which may enhance the predictability and coherence of the law under UNCLOS and thus secure its role as the predominant and relevant system for legal governance at sea for many decades to come. As a contribution to ensuring the future relevance of UNCLOS, the book will be a valuable resource for scholars, diplomats, judges and other practitioners who are working with and interpreting the law of the sea and related issues of maritime law, migration law, human rights law and humanitarian law.
