This book provides the first comprehensive analysis of factors that transform a prima facie non-international armed conflict (NIAC) into an international armed conflict (IAC) and the consequences that follow from this process of internationalization. It examines in detail the historical development as well as the current state of the relevant rules of international humanitarian law. The discussion is grounded in general international law, complemented with abundant references to case law, and illustrated by examples from twentieth and twenty-first century armed conflicts. In Part I, the book puts forward a thorough catalogue of modalities of conflict internationalization that includes outside intervention, State dissolution, and recognition of belligerency. It then specifically considers the legal qualification of complex situations that feature more than two conflict parties and contrasts the mechanism of internationalization of armed conflicts with the reverse process of de-internationalization. Part II of the book challenges the conventional wisdom that members of non-State armed groups do not normally benefit from combatant status. It argues that the majority of fighters belonging to non-State armed groups in most types of internationalized armed conflicts are in fact eligible for combatant status. Finally, Part III turns to belligerent occupation, traditionally understood as a leading example of a notion that cannot be transposed to armed conflicts occurring in the territory of a single State. By contrast, the book argues in favour of the applicability of the law of belligerent occupation to internationalized armed conflicts.

The past two decades have witnessed the rapid proliferation of private military and security companies (PMSCs) in armed conflicts around the world, with PMSCs participating in, for example, offensive combat, prisoner interrogation and the provision of advice and training. The extensive outsourcing of military and security activities has challenged conventional conceptions of the state as the primary holder of coercive power and raised concerns about the reduction in state control over the use of violence. Hannah Tonkin critically analyses the international obligations on three key states - the hiring state, the home state and the host state of a PMSC - and identifies the circumstances in which PMSC misconduct may give rise to state responsibility. This analysis will facilitate the assessment of state responsibility in cases of PMSC misconduct and set standards to guide states in developing their domestic laws and policies on private security.

Armed groups operating beyond the state have become the most important actors in most contemporary wars and violent conflicts, from Iraq and Afghanistan to Colombia and Somalia. They come in a dizzying array of forms: some informally linked to the state and state power, others in opposition to the state; some pursuing classic political goals, others primarily predatory and large-scale criminal enterprises. All groups, however, challenge the state’s Weberian monopoly of the legitimate use of force, yet their origins, evolution, violent dynamics, and relations with state power are poorly understood. War has traditionally been studied as a problem deriving from the relations between states. Strategic doctrines, arms control agreements, and the foundation of international organizations such as the United Nations are designed to prevent wars between states. Since 1945, however, the incidence of interstate war has actually been declining rapidly, while the incidence of internal wars has been increasing. The author argues that in order to understand this significant change in historical patterns, we should jettison many of the analytical devices derived from international relations studies and shift attention to the problems of 'weak' states, those states unable to sustain domestic legitimacy and peace. This book surveys some of the foundations of state legitimacy and demonstrates why many weak states will be the locales of war in the future. Finally, the author asks what the United Nations can do about the problems of weak and failed states.
