Nei saggi raccolti in questo volume si affronta il problema della involuzione della forma teorica, delle tecniche e delle istituzioni tradizionali dello Stato costituzionale contemporaneo (parlamento e governo, partito politico, alternativa federalista, principio di uguaglianza e tutela delle libertà) fra tradizione liberale e trasformazione democratica. È possibile che una democrazia possa rimanere tale se lo Stato diventa pervasivo al punto da soffocare le libertà individuali? È giusto che i cittadini abbiano voce in capitolo sul livello di spesa pubblica? Una tassazione che cresce senza limite per finanziare una spesa non esplicitamente approvata, non è in qualche modo illegittima? C’è un modo per invertire la deriva statalista in atto nel nostro paese, che sta avvenendo con la complicità di tutte le forze politiche? Sono queste alcune delle domande che si pone l’autore, che partendo dalla ricerca di una strategia liberale per proteggere la libertà, sviluppa una vera e propria teoria per evitare che una democrazia si trasformi in una dittatura della maggioranza. La teoria della Forza Guardiana individua una possibile soluzione per limitare il perimetro di azione dei partiti tradizionali e la degenerazione dello Stato. La Forza Guardiana è l’unica forza cui possono riferirsi con coerenza sia liberali, sia chi liberale non è, perché trova in tale forza e nel suo unico obiettivo, magari temporaneamente, un minimo comune denominatore condivisibile. La Forza Guardiana non è solo un nuovo attore del gioco democratico, ma è un elemento strutturale e fondante del gioco stesso, in quanto si affianca e dà vigore alla Costituzione come strumento per limitare la deriva autoritaria di uno Stato; deriva che, indipendentemente dal colore politico, è sempre di tipo statalista. La Forza Guardiana diventa così la forza che vuole salvare la democrazia da se stessa.
