Il costituzionalismo è una dimensione che ha conquistato lo Stato. Quella tra Stato e costituzione è divenuta una simbiosi così potente da contagiare anche ordinamenti giuridici, come quello europeo o internazionale, che si contendono il titolo di “costituzionale”. Se questa constatazione dice molto sulla portata simbolica del termine, non rispecchia tuttavia la realtà istituzionale che vede la costituzione solidamente ancorata allo Stato. Ingredienti necessari ne sono il principio democratico, la separazione dei poteri e lo stato di diritto. Non tutte le vicende storiche che hanno portato alla maturazione di questo concetto vantano tuttavia lo stesso peso. Inghilterra, Germania e Francia svettano tra le altre e sono pertanto oggetto di questa ricerca in quanto modelli. Comparazione o storia nella ricostruzione di questa epopea? In questo libro prevale la seconda nella convinzione che l’individualità degli itinerari non possa essere adeguatamente compresa senza ripercorrerla dalle sue origini.

Le monografie che trattano i rapporti giuridici fra la Chiesa e un determinato Stato, di regola, sono scritte nella lingua del medesimo Stato e, di conseguenza, trovano poca attenzione all’estero. È lodevole, pertanto, l’iniziativa di spiegare tali rapporti ai lettori italiani per quanto riguarda la Germania. Il tentativo di aumentare la conoscenza della situazione dei cattolici in altri Paesi contribuisce a promuovere, nonostante le notevoli differenze storiche, giuridiche e culturali, il senso di unita fra i fedeli delle differenti Nazioni. Il volume è curato dal Cons. Lorenzo Trapassi e da Mons. Andrea Francia, conoscitori privilegiati della materia, in quanto, prestando servizio rispettivamente presso l’Ambasciata d’Italia e la Nunziatura Apostolica a Berlino, hanno potuto condurre la ricerca attraverso il retroterra professionale di ciascuno e la loro sensibilità per le questioni dell’ambito statale ed ecclesiale, completandosi in modo armonico ed equilibrato. Lo studio ha il merito di raggruppare i testi dei rispettivi regimi giuridici e di presentarne gli elementi essenziali. Esso completa così le pubblicazioni già esistenti circa i singoli trattati e le diverse sfere di cooperazione e offre una visione più ampia, stabilendo un nesso con lo sfondo storico e collegandolo con le questioni concrete. Tale procedimento permette di accorgersi delle molteplici interconnessioni esistenti tra la Chiesa e lo Stato tedesco, nonché delle loro particolarità storico-culturali, dovute, fra l’altro, al sistema federale della Germania.

This book argues that the effective protection of fundamental rights in a contemporary, multicultural society requires not only tolerance and respect for others, but also an ethics of reciprocity and a pursuit of dialogue between different cultures of human rights. Nowadays, all cultures tend to claim an equitable arrangement that can be articulated in the terms of fundamental rights and in the multicultural organization of the State. Starting from the premise that every culture is and always was intercultural, this book elaborates a new, and more fundamentally, pluralist view of the relationship between rights and cultural identity. No culture is pure; from the perspective of an irreducible cultural contamination, this book argues, it is possible to formulate constitutional idea of diversity that is properly intercultural. This concept of intercultural constitutionalism is not, then, based on abstract principles, but nor is it bound to any particular cultural norm. Rather, intercultural constitutionalism allows the interpretation of rights, rules and legal principles, which are established in different contexts.
