Since the year 2000, the material and personal scope of EU non-discrimination law has been significantly broadened and has challenged national courts to introduce a comprehensive equality framework into their national law to correspond with the European standard. The book provides a multi-layered culturally informed comparison of juridical approaches to EU (in)direct sex and sexualities discrimination and its implementation in Germany and the Netherlands. It examines how and why national courts apply national non-discrimination law with a European origin differently, although the legislation derives from the same set of EU law and the national courts have to respect the interpretive competence of the CJEU. The book provides valuable insights into the national and European context which shape the dialogue and influences of the courts inter se, the national application of EU law, and the harmonisation process within the area of gender equality law and beyond. A Dutch and German comparison is of special interest here because both countries' approaches towards non-discrimination law are quite different despite the similarities in the respective legal systems; they are founding members of the EU, they are neighbours, they are civil law countries, and their legal systems are relatively similar at least compared to Scandinavian and common law jurisdictions. Therefore, the different reception EU non-discrimination law cannot simply be explained by obvious differences between the legal systems. Their comparison thus provides an interesting case study to uncover legal and non legal, cultural and historic, factors which influence the application of EU non-discrimination law in both countries. The book is of interest for EU, comparative and equality lawyers.

Sam Cherribi is a Moroccan Muslim who became a naturalized Dutch citizen and member of the Dutch Parliament. In this book he draws on his personal experiences with European politics and media, extensive fieldwork in Dutch mosques, and interviews with imams. In recent years, the Netherlands has been swept by the same forces of change that have swept the rest of Europe: the consolidation of the European Union, a massive influx of Muslim immigrants and the rising voice of Islamic fundamentalism. Cherribi argues that this small country has amplified these forces, providing a useful lens through which to examine trends in all of Europe. The portents are troubling, he notes, as evidenced by the murders of journalist Pim Fortuyn and filmmaker Theo Van Gogh, after which riots broke out, mosques were burned, and Muslims were openly reviled by the public and the media. Cherribi himself was voted out of Parliament in the anti-migrant fervor that engulfed the Netherlands after these murders and, like many other Dutch Muslims, he emigrated to the United States. Looking back on these events, and bringing to bear his skills and training as a sociologist, Cherribi provides an invaluable account of one country's encounter with some of the most troubling trends of our times.

"This volume, the result of four years of work performed by the combined research groups of Utrecht University (Faculty of Humanities) and the HU Utrecht University of Applied Sciences (Faculty of Education), focuses on the central theme of ‘Normative Professionalization’. Drawing on a wide variety of scholars including Hannah Arendt, Gert Biesta, Harry Kunneman, Donald Schön and Chris Argyris, and engaging with professionalism, ethics, virtue and morality, this book builds the argument that learning to deal with complexity supports not only education but the personal development of teachers and the improvement of society and democracy as well. This volume presents research on a broad range of topics such as worldview education, co-teaching, moral authorship, traditional-reform perspectives on education, the discourse on citizenship, teacher education, and the question how to link religion and education. The research chapters explain the theoretical lenses and methodological approaches which have been employed to get a grip on complexity. The results have been interpreted in light of the concepts of horror complexitatis, amor complexitatis and dolor complexitatis. Guided by detailed research accounts of worldview descriptions provided by students and teachers, this framework has been enriched with the notion of a passio complexitatis. In the concluding chapters, the book advocates for an improved balance between the normative and instrumental professionalization of teachers, in order to create space for the improvement of pedagogical relations and processes and to reintroduce the moral dimensions of education. The claim throughout this book is that allowing for complexity in education – even going so far as to embrace it – is vital for the improvement of education, and a prerequisite for more authentic relationships (on the micro level) and the maintenance of a well-functioning democracy and a balanced society (on the macro level).
