Em 6 de fevereiro de 2001, o Partido Trabalhista Brasileiro (PTB) ajuizou a Ação Direta de Inconstitucionalidade nº 2404, contra o artigo 254, do Estatuto da Criança e do Adolescente que classifica como infração administrativa a transmissão de programa de rádio ou televisão em horário diverso do autorizado pelo governo federal. No julgamento inicial da ação, quatros ministros foram unânimes em afirmar que: “As emissoras podem definir livremente sua programação de conteúdos inadequados para criança sem interferência do Estado e que em caso extremo basta que os pais desliguem a televisão”. O primeiro a votar nesse sentido foi o relator da ação, ministro Dias Toffoli, que foi acompanhado pelos ministros Luiz Fux, Cármen Lúcia Antunes Rocha e Ayres Britto e em seguida em 30 de novembro de 2011, o julgamento foi suspenso por pedido de vista do ministro Joaquim Barbosa. 1.1 A suspensão do julgamento da ação em 2011 1.2 Ministros foram unânimes em dizer que não cabe ao Estado o controle do horário da programação de TV e que em caso extremo basta que os pais desliguem a televisão 1.3 Ministro Luiz Fux afirma que o Estado não deve interferir no horário da programação de TV e nem exercer o papel de oráculo da moral 1.4 Ministra Cármen Lúcia diz que o artigo 254 do ECA é uma verdadeira mordaça 1.5 Ministro Ayres Britto entende que o Estado não está autorizado a tutelar ninguém, sobretudo no plano ético 1.6 Principais pontos do relatório do voto do Ministro Dias Toffoli 2.1 Relator da ONU é contra a ação e diz que o Estado tem obrigação de regular a proteção da infância 2.2 Ministra Carmen Lúcia em outra ação de inconstitucionalidade afirma que Tratado Internacional permiti a censura prévia para proteção moral da infância 2.3 Juíza Federal diz que ministro Dias Tofolli esqueceu de mencionar que existe o controle de conteúdo impróprio para criança na TV nos Estados Unidos. 2.4 Procurador da República (MPF) diz que a televisão, por ser uma concessão de serviço público, deve ser fiscalizada pelo Estado 2.5 Para o Ministro Dias Toffoli é o Estado e não o poder judiciário que pode proibir os horários não recomendados para criança na TV 2.6 Ministério Público Federal e Advocacia Geral da União(AGU) são contra a ação de Inconstitucionalidade 2.7 A Constituição Federal afirmar explicitamente que é dever do Estado proteger a criança e ao adolescente com absoluta prioridade 3.1 Pesquisa aponta que 97% dos pais ou responsáveis por crianças e adolescentes consideram muito importante a classificação indicativa de TV pelo Estado 3.2 Estudos nos EUA comprovam que exposição de crianças a cenas de sexo e violência na TV causam sexualidade precoce e comportamento agressivo 3.3 O Guia Prático de Classificação Indicativa para TV brasileira 3.4 Pesquisas indicam que o consumo de maconha faz mal a saúde 3.5 Entidades assinaram manifesto em defesa da classificação Indicativa na televisão pelo Estado

This striking study of the meaning and use of the major spatial prepositions in French provides valuable insight into how the human mind organizes spatial relationships. Most previous analyses of spatial prepositions have assumed that their semantic properties can be adequately explained by familiar logical and geometrical concepts. Thus, the standard view of the preposition "in" as it appears in the sentence "the ball is in the bag" postulates that it refers to the geometrical relation of inclusion. This paradigm, however, falters when faced with the contrast in acceptability between sentences such as "the bulb is in the socket" and "the bottle is in the cap." The force exerted by the "landmark" (a conceptually fixed object) on the "target" (a moveable object) is crucial in this difference: the functional notion of containment seems more operational in the use of the preposition "in" than inclusion. That is, what are taken to be the landmark and the target depend greatly on the functions these objects serve in the human scheme. This offers important clues to otherwise problematic linguistic quirks, such as why one sleeps in one's bed, while one is said to lie on one's deathbed. While many of the examples apply in English as well as French, there are some noteworthy differences—in French one sits on a chair, but in a couch. Vandeloise convincingly argues that it is precisely this subjective element which makes a standard geometrical account unfeasible.

American Neoconservatism moves beyond recent debates over the intricacies of the Bush administration's foreign policy to offer a deeper look at the philosophical premises of this 'new' conservatism in light of the historical events and changing social compacts that have created a demand for it over the past decades. It surveys neoconservative discourses on democracy, the liberal state, capitalism, national security, international law and global liberal governance, and draws attention to the systematic links between the domestic and international dimensions of neoconservative political sociology. Taking issue with neoconservatism's self-image, Drolet argues and demonstrates that American neoconservatism is not the centrist 'liberal' conservatism that it pretends to be--and that many analysts have diagnosed in recent years. To the extent that neoconservatism is committed to the Enlightenment discourse of liberalism, these commitments are firmly subordinated to an authoritarian form of cultural and philosophical conservatism, which is in fact ferociously predatory on liberal values and practices. Neoconservatism is not a conservative variant of liberalism but a deeply atavistic reaction to liberal modernity. It owes a lot more to the authoritarian intellectual milieu of interwar Europe than to the liberal tradition that its protagonists allegedly want to reform and protect against its enemies.
