La Storia delle costituzioni ha assunto da tempo una sua forte e specifica fisionomia: non solo sul piano scientifico (dove la conquista era antica e consolidata), ma anche nel panorama della didattica universitaria. Una delle prove più convincenti dell’autonomia didattica che questa disciplina ha raggiunto negli studi universitari italiani è certamente offerta da questo Corso di lezioni del Fioravanti, tanto è stato il successo e tanti i riconoscimenti che ha meritatamente riscosso fino dalla sua prima edizione. Le ragioni (ovvie, peraltro) di questo successo sono scritte a chiarissime lettere fin dalla prefazione di questo libro: il cui dichiarato scopo è quello di rivelare ai suoi lettori la “dimensione storico-culturale” del diritto pubblico moderno come “prodotto della storia”; in modo che poi risulti più facile e motivata la comprensione di quel “complesso più o meno sistematicamente ordinato di norme giuridiche” che a prima vista sembrerebbe essere la sostanza più appariscente di quel “diritto”. Le ragioni che hanno mosso il Fioravanti a scrivere queste Lezioni per i suoi studenti fiorentini son le medesime che hanno guidato a progettare questa Collana che ora ne ospita la terza edizione, perché sono le sole che giustificano la presenza della storia fra le discipline indispensabili alla formazione d’un giurista che sappia fare fino in fondo il suo mestiere.
