Die Studie untersucht Sinn und Zweck der Straftatbestände zum Schutz des Wettbewerbs im 26. Abschnitt des Strafgesetzbuchs. Zunächst wird die historische Entwicklung dieser Straftatbestände dargestellt und der Frage nachgegangen, was den Gesetzgeber zu ihrer Aufnahme in das Strafgesetzbuch veranlasst hat. Anschließend werden Strafwürdigkeit und Strafbedürftigkeit dieser Delikte erörtert. Daneben wird geklärt, welchen Stellenwert die Wettbewerbsdelikte in der Praxis der Strafverfolgung haben und ob europäische Vorgaben die Wettbewerbsdelikte im Strafgesetzbuch legitimieren können. Auf Grundlage der gefundenen Ergebnisse arbeitet der Verfasser heraus, dass der freie Wettbewerb als solcher keinen strafrechtlichen Schutz genießen sollte, und dass die strafrechtlichen Steuerungsmöglichkeiten innerhalb der marktwirtschaftlichen Ordnung - insbesondere aus rechtsstaatlicher Sicht - kein taugliches Instrument für den Schutz von wirtschaftlichen Allgemeininteressen sind.

This book offers a comprehensive analysis of the legal questions that arise for the legislative branch when implementing the crime of aggression into domestic law. Despite being the “supreme international crime” that gave birth to international criminal law in Nuremberg, its ICC Statute definition has been incorporated into domestic law by fewer than 20 States. The crime of aggression was also omitted in the rich debate held among German scholars in the early 2000s regarding the legislative implementation of other ICC Statute crimes. The current inability of the International Criminal Court to respond to the Russian aggression towards Ukraine invites the continuation of these academic debates without neglecting the particularities of the crime of aggression. The fundamental issues discussed in this volume include the obligation to criminalize aggression, the core wrong of the crime, the normative gaps under domestic law and the jurisdictional gaps under the ICC Statute. To facilitate the operationalization of domestic implementation, the book explores the technical options for incorporating the definition into domestic law, the geographical ambit of domestic jurisdiction—most notably universal jurisdiction—as well as legal challenges such as immunities. The book is aimed primarily at researchers and States with an interest in the domestic implementation of international criminal law but those already working in the field should also find much of interest contained within it. Dr. Annegret Hartig is Program Director of the Global Institute for the Prevention of Aggression and worked as a researcher at the University of Hamburg where she obtained her doctoral degree in international criminal law.

This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.

The main aim of this book is to discuss the state of unfair competition law in the European Union. In this respect, the various efforts that have been made in the past to come to harmonization of this area of law and the reasons that they were only partially successful are reviewed. In addition, the International and European regulations that refer to unfair competition, like, e.g., the Paris Convention, the TRIPs and the recent 2004 Unfair Commercial Practices Directive are discussed. Also an overview is given of the unfair competition laws in the United Kingdom, Germany and the Netherlands with respect to the 'problem-areas' of slavish imitation, misleading advertising, denigrating one's competitor, trade secrets and finally, misappropriation of valuable trade assets. Unfair competition law is traditionally considered part of intellectual property law.
