Questions regarding how to improve the transitional phase from prison to life in society after release have gained major importance in the last decade in criminal policy. All over the world release preparation and resettlement practice are discussed with the aim to reduce negative effects of imprisonment and re-offending rates. Small and large reforms aiming at the improvement of release processes and reintegration strategies have taken place in many European states. This book describes the current European landscape of prisoner resettlement and brings together the results and ideas of leading European academic experts with the ambition of furthering national, European and international reform debates. This book presents national reports about resettlement processes and structures in 20 European countries: written by national scholars, these reports reveal important actors in resettlement processes as well as political decisions about the role of the communities in "taking the prisoners back", or the use of early release as a strategy to motivate the released prisoner to enter into a future without crime. Einer der Schwerpunkte der Forschung am Greifswalder Lehrstuhl für Kriminologie ist seit dessen Aufbau Anfang der 1990er Jahre auf den internationalen Vergleich des Strafvollzugs ausgerichtet. Dabei spielen immer wieder menschenrechtliche Fragen und die Bestandsaufnahme der realen Lebensbedingungen eine besondere Rolle. Die vorliegende Arbeit steht in der Tradition dieses strafvollzugsrechtlichen For-schungsprogramms und widmet sich der Entwicklung des Heimatlands der Autorin, Polen. Bereits in der Einleitung deutet die Verfasserin die besonderen Problemlagen des polnischen Strafrechts- und Strafvollzugssystems an. In der Tradition der Länder des ehemaligen Ostblocks wurde und wird von der Freiheitsstrafe sehr viel häufiger Gebrauch gemacht als beispielsweise in Deutschland. Dementsprechend war die Gefangenenrate 2013 mit 223 pro 100.000 der Wohnbevölkerung dreifach erhöht (Deutschland: 80). Mit der Integration in die gesamteuropäische Wertegemeinschaft durch Beitritt zum Europarat und 2004 die Aufnahme in die Europäische Union ha-ben Menschenrechtsfragen in Polen eine besondere Bedeutung gewonnen. Ein zentrales Anliegen der Publikation ist es, die Rezeption europäischer Menschenrechtsstandards durch die polnische straf- und strafvollzugsrechtliche Literatur, die Rechtsprechung und schließlich die Vollzugspraxis aufzuzeigen.

Der Schutz von Ehe und Familie hat Verfassungsrang und entfaltet seine Bedeutung im Strafvollzug in besonderem Maß, zumal das Grundrecht durch den Freiheitsentzug in intensivem Maß eingeschränkt wird. Durch die Föderalismusreform im Jahr 2006 und im Gefolge die Verabschiedung von Landesstrafvollzugsgesetzen ist eine familien- und ehefreundliche Gestaltung des Vollzugs zu einem zentralen Thema geworden, insbesondere im Kontext der Besuchsregelungen. Die Arbeit widmet sich der 2016 reformierten Vorschrift des § 177 StGB und analy-siert den Ertrag dieser Reform hin zu einem umfassenderen Schutz der sexuellen Selbstbestimmung durch die Einführung des „Nein heißt Nein!“-Ansatzes in das deutsche Recht. Hierfür analysiert die Autorin nach einer Vorstellung der Norm und ihrer Probleme einerseits bisher zu § 177 StGB n.F. ergangene gerichtliche Ent-scheidungen. Andererseits nimmt sie einen Rechtsvergleich mit Irland als Rechts-ordnung, die schon länger ein Konsensprinzip in der Form des „Nein heißt Nein!“ kennt, vor und analysiert die dort mit der Regelung gemachten Erfahrungen. Schließlich wirft sie auch noch einen kurzen Blick auf „Ja heißt Ja!“-Regelungen, insbesondere an US-amerikanischen Universitäten sowie im schwedischen Straf-recht. Auf der Basis der gefundenen Ergebnisse nimmt die Autorin schließlich eine Be-wertung der Norm vor und stellt weitere Reformüberlegungen de lege ferenda an. Die Arbeit nimmt dabei eine umfassende Analyse des Themas vor. Es werden straf-rechtliche, strafprozessuale, kriminologische und rechtsvergleichende Perspektiven eingenommen und miteinander verknüpft.
