Inhaltsangabe:Einleitung: In der Bundesrepublik Deutschland fallen jährlich allein im Produzierenden Gewerbe rund 260 Mio. Tonnen Abfall an. Daneben sind noch ca. 15 Mio. Tonnen Sonderabfall zu entsorgen. Mit fast 90 v. H. ist die Deponierung weiterhin der mengenmäßig bedeutendste Weg der Abfallentsorgung. Aber die Kapazitäten sind erschöpft; eine ausreichende Aufnahmefähigkeit der Deponien für die verschiedenen Schadstoffe ist häufig nicht mehr gegeben. Zudem werden die Flächen für die Deponierung knapper. Die Entsorgungsproblematik wird durch die mangelnde öffentliche Akzeptanz für Entsorgungsanlagen noch vergrößert. Die Folgen sind beträchtlich: Die Umweltmedien werden zunehmend belastet. Die Kosten für die Behandlung und Entsorgung von Abfällen sind erheblich gestiegen. Infolgedessen haben sich die Fälle illegaler Verbringungen vor allem in die Staaten Mittel- und Osteuropas gehäuft. Und nicht zuletzt machen die Engpässe in der Abfallentsorgung auch die ökölogischen und ökonomischen Grenzen für den Wirtschaftsstandort Deutschland sichtbar. Als einer der führenden Industriestaaten ist die Bundesrepublik gleichzeitig auch einer der Ressourcenverbraucher. Da Deutschland aber ein rohstoffarmes Land ist, müssen die meisten Rohstoffe eingeführt werden. Der sparsame Umgang mit den Ressourcen, die Wiederverwendung und Verwertung von Abfällen ist deshalb nicht nur ökologisch sinnvoll, sondern auch eine zwingende wirtschaftliche Notwendigkeit. Die systematische Entwicklung einer umweltverträglichen Abfallwirtschaft, in der Produktion, Verteilung und Gebrauch von Gütern sowie deren Entsorgung als geschlossenes System gesehen werden, ist vor diesem Hintergrund unerläßlich. Der Staat, die Wirtschaft und jeder einzelne ist hier gleichermaßen gefordert. Mit Blick auf das ordnungsrechtliche Instrumentarium wurde der erste Schritt von einem bloßen Recht der Abfallwirtschaft mit der vierten Novellierung des Abfallbeseitigungsgesetzes im Jahre 1986 vollzogen. Einen weiteren Schritt hat der Gesetzgeber jetzt mit dem Gesetz zur Förderung der Kreislaufwirtschaft und Sicherung der umweltverträglichen Beseitigung von Abfällen getan. Gang der Untersuchung: Im folgenden Abschnitt sollen zunächst einige Daten zur Situation der Abfallentsorgung in Deutschland die angesprochene Problematik veranschaulichen. "This current volume is a result of the Seventh and Eighth International Forum on Sustainable Technological Development in a Globalizing World. The Seventh Forum was held June 9-12, 2010 in Berlin. The Karlsruhe Institute of Technology hosted the event, which was organized around culture and sustainability. What we each value as a society, as a country, in our culture, is what we want to protect. What is sustainable is only what we value. This applies all the more to sustainable development which is planned for long time scales and therefore to go beyond individual sustainable technology solutions as well as economic and political cycles. What we hold in high regard is the result of cultural influences. Consequently, we need cultural change in the sense of sustainable development in order to secure sustainability pathways in the long term. The key question arising is whether and how this change can be brought about. The following Introduction leads us into the specific discussion. At the end of the Seventh Forum, participants concluded that more specific case studies would be useful and recommended that the Eighth Forum provide a focus for case studies. Since the remainder of the Eighth Forum, held March 8-10, 2011, in Melbourne, Florida, focused on Alternative Energy with oral papers not really appropriate as written papers, it was decided to include the case studies in combination with those papers from Berlin to provide a holistic discussion of culture and sustainability. The Electrical and Electronic Equipment Act (ElektroG) that took effect in 2005 follows an independent method as opposed to the conventional execution carried out by state authorities with regards to the legal execution. It commits the producer of electrical and electronic equipment to the establishment of a private law Clearing House (Gemeinsame Stelle) and assigns it numerous tasks to be carried out on its own responsibility. The significance of the Clearing House for the implementation of the Electrical and Electronic Equipment Act is heightened by the fact that it assumes additional sovereign tasks assigned to it within the scope of the designation. This unusual double function is applied to the task at hand and illuminates the status and organisation of Stiftung Elektro-Altgeräte-Register that is set up as Clearing House. The task furthermore examines the most important tasks in practice of producer registration and the coordination of WEEE collection, as well as the thus far little researched task of specifying the equipment types important for implementation. The work is rounded off by a chapter dedicated to the issues of legal protection against the measures of Stiftung Elektro-Altgeräte-Register, particularly in its function as designated agency.
