La ricerca si propone di ricostruire l’effettivo significato della nozione di ‘universitas’ attraverso l’individuazione di una tipologia delle varie ipotesi in cui compare tale termine, ricavata dall’esegesi dei passi dei giureconsulti romani che lo hanno utilizzato; al fine di affrontare il problema in tutte le sue sfaccettature, questa analisi sarà accompagnata altresì dall’esame dei testi degli autori letterari. Dalle accezioni proprie del linguaggio comune si passa quindi all’uso della parola, già a partire dall’epoca classica, da parte dei giuristi, che vi ricorrono per considerare, come centro unitario di imputazione di rapporti giuridici, una pluralità che, a seconda dei casi, può essere costituita di res e/o di diritti oppure di persone: i risultati cui si sarà pervenuti verranno confrontati con le costituzioni imperiali e con alcuni testi desunti da varie opere tardoantiche in cui si riscontra il ricorso a tale nozione. La trattazione si conclude con un confronto tra l’universitas e un altro fenomeno apparentemente molto simile, i cd. corpora ex distantibus, ossia più cose semplici non congiunte tra loro e tuttavia considerate unitariamente, come ad esempio il gregge, per fare emergere affinità e differenze tra le due nozioni.
