The 1279-80 hundred rolls are one of the most important sources for later thirteenth century England, yet this is the first comprehensive study of the inquiry which brought them into being. Proceedings Against the Crown (1216 1377) The two monographs of the present volume are closely connected: they illustrate the two aspects of the Constitutional development of England in the thirteenth and fourteenth centuries. The inquests as to misdoings Of Officers and. Encroachments on public rights Show the insistence of the Crown In its efforts to keep order and to suppress administra tive abuses. But this very insistence was a source of hardship and gave rise to constant grievances, because the King and his ministers were apt to brush away established customs and to exert arbitrary despotism on the pretext of enforcing discipline and serving the interests of the Community. A strong opposition to such high-handed acts was manifested on many occasions, and found an appropriate basis in the juridical conceptions and traditions of feudal society - a society which looked upon convention and custom as the ruling principles of the law. Dr. Ehrlich traces the influence of this peculiar legalism in the early history of Proceedings against the Crown, and shows that the contradictory statements of Bracton's treatise are connected with different ten dencies in the actual practice of the law.
