This book explores the relationship between space, subjectivity and property in order to invert conventional socio-legal understandings of property. Sarah Keenan demonstrates that new political possibilities for property may be unveiled by thinking about property in terms of space and belonging, rather than exclusion. Drawing on feminist and critical race theory, this book shifts focus away from the propertied subject and on to the broader spaces in and through which the propertied subject is located. Using case studies, such as analyses of compulsory leases under Australia’s Northern Territory Intervention and lesbian asylum cases from a range of jurisdictions, Keenan argues that these spaces consist of networks of relations that revolve around belonging: not just belonging between subject and object, as property is traditionally understood, but also the less explored relation of belonging between the part and the whole. This book therefore offers a conceptually useful way of analysing a wide range of socio-legal issues. It will be of relevance to those working in the area of property and legal geography, but also to those with more general interests in socio-legal studies, social and political theory, postcolonial studies, critical race studies and gender and sexuality studies.

Property tends to operate and to be understood as a conservative social force, but can property also be subversive? This book explores the relationship between space, subjectivity and property, in order to invert conventional socio-legal understandings of property that revolve around possession and to theorize property in terms of belonging. Drawing on feminist and critical race theory, the book shifts the focus away from the propertied subject and onto the broader spaces in which the propertied subject is located. Those spaces, it is argued, consist of networks of relations that revolve around belonging: not just belonging between subject and object, as property is traditionally understood, but also the less explored relation of belonging between the part and the whole. Thinking about property in terms of space and belonging reveals new political possibilities for property. And the theory of property as a spatially contingent relation of belonging proposed in this book not only offers a conceptually useful way of analysing a wide range of socio-legal issues, it enables new connections to be drawn between them. This book focuses on the fraught relationship between cultural heritage and intellectual property, in their common concern with the creative arts. The competing discourses in international legal instruments around copyright and intangible cultural heritage are the most obvious manifestation of this troubled encounter. However, this characterization of the relationship between intellectual and cultural property is in itself problematic, not least because it reflects a fossilized concept of heritage, divided between things that are fixed and moveable, tangible and intangible. Instead the book maintains that heritage should be conceived as part of a dynamic and mutually constitutive process of community formation. It argues, therefore, for a critically important distinction between the fundamentally different concepts of not only intellectual and cultural heritage/property, but also of the market and the community. For while copyright as a private property right locates all relationships in the context of the market, the context of cultural heritage relationships is the community, of which the market forms a part but does not – and, indeed, should not – control the whole. The concept of cultural property/heritage, then, is a way of resisting the reduction of everything to its value in the market, a way of resisting the commodification, and creeping propertization, of everything. And, as such, the book proposes an alternative basis for expressing and controlling value according to the norms and identity of a community, and not according to the market value of private property rights. An important and original intervention, this book will appeal to academics and practitioners in both intellectual property and the arts, as well as legal and cultural theorists with interests in this area.

This book deepens our understanding of humanity’s diverse relationships with water and the law, providing a critical assessment of this relationship, and charting the course towards a more sustainable and just water future. By using legal geography, this book pays particular attention to the place-based inter-relationships between water, people, and law (both formal and informal) and to the ways that law both constitutes and is constituted by the relationship between people and place. Starting in the 1980s, Chapter 2 investigates the early commodification of water through the liberalisation of rural water markets in Chile and the urban water supply and sanitation systems of England and Wales. Chapter 3 then examines the global expansion of neoliberal water governance in the 1990s, starting with donor-driven reforms in the global south and particularly Manila in the Philippines. Chapters 4 and 5 document both the grassroots response to these neoliberal water reforms and the inherent tensions in the attempts of the early 2000s to reconcile the recognition of a human right to water with the ongoing rollout of market mechanisms, both in the domestic context of South Africa and within the United Nations human rights system. Moving forward again, Chapter 6 examines the recent intensification of neoliberal water governance through financialisation and considers its specific impacts in Detroit and Flint, Michigan. Chapter 7 then considers the renewed global emphasis on living waters and Indigenous ontologies of water by examining the new legislative arrangements for the Whanganui River in Aotearoa, New Zealand. The book concludes in Chapter 8 by highlighting the stories of hope that can be found in many of the case studies explored in the book and in emerging examples from around the world. The concept of the cultural commons has become increasingly important for legal studies. Within this field, however, it is a contested concept: at once presented as a sphere for creativity, democratic access and freedom of speech, but one that denies property rights and misappropriates the public domain. In this book, Merima Bruncevic takes up the cultural commons not merely as an abstract notion, but in its connection to physical spaces such as museums and libraries. A legal cultural commons can, she argues, be envisioned as a lawscape that can quite literally be entered and engaged with. Focusing largely on art in the context of the copyright regime, but also addressing a number of cultural heritage issues, the book draws on the work of Deleuze and Guattari in order to examine the realm of the commons as a potential space for overcoming the dichotomy between the owner and the consumer of culture. Challenging this dichotomy, it is the productive and creative potential of law itself that is elicited through the book’s approach to the commons as the empirical basis for a new legal framework, which is able to accommodate a multitude of interests and values.
