This study aims to understand the implications of stricter food safety regulations and certification systems to the food industry and to find ways to manage risks and costs associated with these regulations and systems. This paper empirically examines the timing of initial decisions to adopt food safety systems and subsequent decisions to maintain the certification. Survival models are used to evaluate firm-level decisions among seafood processors in the Philippines. Whereas initial certification decisions were influenced mainly by easily obtainable a priori indicators such as output price, scale of production, and association membership, decisions to continue certification were influenced by a larger number of less-visible factors including price differentials across markets and cost structures. Managerial hubris may have played a role in initial certification decisions, but decertification decisions were more informed by realized cost–benefit comparisons.

This edited volume evaluates recent EU quality policy, focusing on the structure, governance, technical specifications and performances – economic, environmental and social – of Food Quality Schemes (FQS) in the European Union and South East Asia. The intended benefits of FQS include generating a fair return for farmers and producers, and enabling consumers to make better‐informed purchasing choices through effective labeling. In addition, policy makers now consider FQS as a means of guaranteeing not only quality in food production, but also sustainability. Despite these potential benefits, the economic performance of the FQS (e.g. PDO, PGI, organic) has been variable. While some support significant value‐added production, with substantial benefits to producers, consumers and wider economies, many others have failed to become economically sustainable. In addition, the environmental and social performance of FQS remains largely unexamined, with the exception of the environmental performance of organic products. The editors examine these discrepancies and offer a nuanced evaluation of the effectiveness of such policies. Several unique features make this volume a key resource for those interested in FQS and in the sustainability of food products. The editors provide a concise description of the value chain, the governance and the technical specifications of 27 FQS in Europe and South East Asia. The editors also provide a sustainability assessment of each of these FQS, and support or question the view that FQS are moving from “quality” to “sustainability.” Finally, the volume serves as a repository of key data on these FQS. Since the turn of the Millennium, world-wide initiatives from the private sector have turned the regulatory environment for food businesses upside down. For the first time in legal literature this book analyses private law initiatives relating to the food chain, often referred to as private (voluntary) standards or schemes. Private standards are used to remedy flaws in legislation, in order to reach higher levels of consumer protection than the ones chosen by the EU legislature and to manage risks and liability beyond the traditional limits of food businesses. We see that litigation is no longer solely framed by legislative requirements, but ever more by private standards such as GlobalGAP, BRC, IFS, SQF and ISO. These private standards incorporate public law requirements thus embedding them in contractual relations and exporting them beyond the jurisdiction of public legislators. Other standards focus on corporate social responsibility or sustainability. This book also addresses how private religious standards such as Kosher and Halal play a role in defining specific markets of growing importance. It is noted that organic standards have found an interesting symbioses with public law. Another development on this topic is that food businesses are inspected more often by private auditors than by public inspectors. Effects in terms of receiving or being denied certification far outweigh public law sanctions. In short private law has changed an entire legal infrastructure for the food sector. It emerges as competing with the public law regulatory infrastructure. This book is of interest to all who concern themselves with food law legislation and litigation and the evolving role of private standards on changing the landscape of food chains and innovation.

The ability of future generations to meet their needs is inherent in the definition of sustainability from 1987. Today the sustainability of a product, a process or a system is assessed according to three dimensions: environment, social and economical sustainability. The lack of environmental sustainability in the present food production system is demonstrated by the heavy dependence on fossil fuel input for fertilizer manufacture and transportation. Global food production is estimated to contribute to about 25% of the emission of “greenhouse gases.” The food production is also the major culprit for problems of eutrophication due to leakage of nutrients into lakes and rivers. Waste in the food chain is another major obstacle for increased sustainability. The socioeconomic dimension of sustainability implies fairness in the economic transaction in the food chain and social justice regarding working conditions. In spite of many efforts by NGOs, governments and the food industry, there are many examples where reasonable sustainability demands are not met today. There are a number of future challenges for improving food production towards a better sustainability in the future.
