The 19th Symposion of the International Society for Greek and Hellenistic Legal History took place in Cambridge MA, August 26-29, 2013. 15 papers were presented, and respondents opened the discussion about every paper. The papers and responses are collected in this volume. They begin with broad looks at Greek law overall, followed by archaic Cretan law, the law of classical Athens, epigraphic evidence from other poleis of Hellenistic and Roman times, legal papyri, and law in later Greek literature. The Symposion supports the cooperation of legal historians with those studying all aspects of Classical Antiquity allowing the participants a free choice of topics from their current areas of research.

The ancient Greeks invented written law. Yet, in contrast to later societies in which law became a professional discipline, the Greeks treated laws as components of social and political history, reflecting the daily realities of managing society. To understand Greek law, then, requires looking into extant legal, forensic, and historical texts for evidence of the law in action. From such study has arisen the field of ancient Greek law as a scholarly discipline within classical studies, a field that has come into its own since the 1970s. This edited volume charts new directions for the study of Greek law in the twenty-first century through contributions from eleven leading scholars. The essays in the book’s first section reassess some of the central debates in the field by looking at questions about the role of law in society, the notion of “contracts,” feuding and revenge in the court system, and legal protections for slaves engaged in commerce. The second section breaks new ground by redefining substantive areas of law such as administrative law and sacred law, as well as by examining sources such as Hellenistic inscriptions that have been comparatively neglected in recent scholarship. The third section evaluates the potential of methodological approaches to the study of Greek law, including comparative studies with other cultures and with modern legal theory. The volume ends with an essay that explores pedagogy and the relevance of teaching Greek law in the twenty-first century.

How did the division of power work in Ancient Greece? This groundbreaking study reveals Ancient Greek political decision-making to be a multi-layered system of delegation and legal control. Scholars have previously examined the nature and locus of sovereignty in the Classical and Hellenistic Greek poleis through institutional, rhetorical, or ideological approaches. By concentrating on the institutional design of decree-making, Alberto Esu moves beyond unitary and hierarchical understandings of sovereignty; he presents a new view of power as divided and horizontally organized between different decision-making institutions, each one with its own discourse and expertise. Greek political decision-making is thus seen through a new institutionalist perspective that rediscovers the normative importance of political institutions as factors shaping the collective behaviour of decision-makers. Part I explores how deliberative power in decree-making was delegated in Classical Athens, Mytilene, and Hellenistic Megalopolis. Part II examines procedures of legal control and judicial review in the Classical and Hellenistic periods. Divided power proves to be a feature of both democratic and non-democratic societies across the Ancient Greek world; Esu's analysis of its institutional manifestation transforms our understanding of political life—its discourses and norms—in the Ancient Greek city-states.

This is a pioneering study that examines the sale of sex in classical Athens from a commercial (rather than from a cultural or moral) perspective. Following the author's earlier book on Athenian banking, this work analyzes erotic business at Athens in the context of the Athenian economy. For the Athenians, the social acceptability and moral standing of human labor was largely determined by the conditions under which work was performed. Pursued in a context characteristic of servile endeavor, prostitution--like all forms of slave labor--was contemptible. Pursued under conditions appropriate to non-servile endeavor, prostitution--like all forms of free labor--was not violative of Athenian work ethics. As a mercantile activity, however, prostitution was not untouched by Athenian antagonism toward commercial and manual pursuits; as the "business of sex," prostitution further evoked negativity from segments of Greek opinion uncomfortable with any form of carnality. Yet ancient sources also adumbrate another view, in which the sale of sex, lawful and indeed pervasive at Athens, is presented alluringly. In a book that will be of interest to all students of sex and gender, to economic, legal and social historians, and to classicists, the author explores the high compensation earned by female sexual entrepreneurs who often controlled prostitutional businesses that were perpetuated from generation to generation on a matrilineal basis, and that benefitted from legislative restrictions on pimping. The author juxtaposes the widespread practice of "prostitution pursuant to written contract" with legislation targeting male prostitutes functioning as governmental leaders, and explores the seemingly contradictory phenomena of extensive sexual exploitation of slave prostitutes (male and female) coexisting with Athenian society's pride in its legislative protection of slaves and minors against sexual outrage.

The volume, jointly promoted by the Department of Classics of Sapienza University and the Institute of Sparta, intends to explore the multifaceted system of connections and interactions among ancient poleis by focusing on Sparta, which acts as an exemplary case study to understand the complex relations among Greek cities in the classical Hellenic world. The latter is indeed composed by an extended range of settlements based on specific jurisdictions, sets of laws and ethical principles, that are nevertheless connected by a common shared culture. From Eusebius of Caesarea, who first compiled a collection of martyr narratives around 300, to Thierry Ruinart, whose Acta primorum martyrum sincera et selecta was published in 1689, the selection and study of early hagiographic narratives has been founded on an assumption that there existed documents written at the time of martyrdom, or very close to it. As a result, a search for authenticity has been and continues to be central, even in the context of today's secular scholarship. But, as Éric Rebillard contends, the alternative approach, to set aside entirely the question of the historical reliability of martyr narratives, is not satisfactory either. Instead, he argues that martyr narratives should be consider as fluid "living texts," written anonymously and received by audiences not as precise historical reports but as versions of the story. In other words, the form these texts took, between fact and fiction, made it possible for audiences to readily accept the historicity of the martyr while at the same time not expect to hear or read a truthful account. In The Early Martyr Narratives, Rebillard considers only accounts of Christian martyrs supposed to have been executed before 260, and only those whose existence is attested in sources that can be dated to before 300. The resulting small corpus contains no texts in the form of legal protocols, traditionally viewed as the earliest, most official and authentic records, nor does it include any that can be dated to a period during which persecution of Christians is known to have taken place. Rather than deduce from this that they are forgeries written for the sake of polemic or apologetic, Rebillard demonstrates how the literariness of the narratives creates a fictional complicity that challenges and complicates any claims of these narratives to be truthful.

The Birth of the Athenian Community elucidates the social and political development of Athens in the sixth century, when, as a result of reforms by Solon and Cleisthenes (at the beginning and end of the sixth century, respectively), Athens turned into the most advanced and famous city, or polis, of the entire ancient Greek civilization. Undermining the current dominant approach, which seeks to explain ancient Athens in modern terms, dividing all Athenians into citizens and non-citizens, this book rationalizes the development of Athens, and other Greek poleis, as a gradually rising complexity, rather than a linear progression. The multidimensional social fabric of Athens was comprised of three major groups: the kinship community of the astoi, whose privileged status was due to their origins; the legal community of the politai, who enjoyed legal and social equality in the polis; and the political community of the demotai, or adult males with political rights. These communities only partially overlapped. Their evolving relationship determined the course of Athenian history, including Cleisthenes’ establishment of demokratia, which was originally, and for a long time, a kinship democracy, since it only belonged to qualified male astoi.

The democratic legal system created by the Athenians was completely controlled by ordinary citizens, with no judges, lawyers, or jurists involved. It placed great importance on the litigants’ rhetorical performances. Did this make it nothing more than a rhetorical contest judged by largely uneducated citizens that had nothing to do with law, a criticism that some, including Plato, have made? Michael Gagarin argues to the contrary, contending that the Athenians both controlled litigants’ performances and incorporated many other unusual features into their legal system, including rules for interrogating slaves and swearing an oath. The Athenians, Gagarin shows, adhered to the law as they understood it, which was a set of principles more flexible than our current understanding allows. The Athenians also insisted that their legal system serve the ends of justice and benefit the city and its people. In this way, the law ultimately satisfied most Athenians and probably produced just results as often as modern legal systems do. Comprehensive and wide-ranging, Democratic Law in Classical Athens offers a new perspective for viewing a legal system that was democratic in a way only the Athenians could achieve.

Some of them deal with wide-ranging issues, such as the presence of Latin in monastic or scholastic contexts alongside local varieties, some others deal with specific subjects, such as the use of Latin in a certain milieux or in specific documents. All papers show that the contact between languages, scripts and cultures took many forms depending on various factors.
